      i am not trying to mislead anyone. im just taking it how i read it and if thats different, then can someone please clarify? when (if) a cop tries to charge me, if i am carrying an unloaded handgun openly, how would i explain it?

      i just want to make sure its 100 legitimate in the wording before i do it.

        too bad you cannot sue for this unlawful detainment
        time is money and you shoudl be compensated

        and if the mall doesnt want guns in there they shoudl have signs

          A rent-a-cop is nothing more than an ordinary citizen. The first and primary duty of a rent-a-cop is to observe and report. Way down at the bottom of the list, (the very bottom) is intervention. Now, a rent-a-cop does have the same authority and is acting as the owner of the property. So, they do have some very important legal power but again, no more than the civilian owner of the property. They do not even have the right to detain you. It could be considered kidnapping or false imprisionment. They do have the right to order you to leave the property though.

            They do have the right to detain you if they see you in the commission of a crime just as any ordinary citizen does.
            In any type of fight, & especially gun fights, there are no winners ..... just varying degrees of losers. The only fight you win is the one you never get into.

              They have the same powers as a citizen's arrest. They can detain (arrest) a person for a misdemeanor that they personally witnessed or they can detain (arrest) for a felony not personally witnessed.

              If the accused is not free to leave then that person has been detained (by the legal definition).

                Who knows exactly? The words are not synonymous, tho.

                Its easy to envision "carry concealed...about the person" as NOT being wearing (in a briefcase, for example).

                It also doesn't observe the Penal Code distinctions that all concealed carry is illegal, WITH exceptions as specified (locked case etc)

                  so at best its a gray area? in other words, as the law is written, would YOU have a problem carrying here? the cops have always been known to be less than honest and fair. which has always somewhat made me hesitant to open carry.

                      Yea, I miss typed what I ment to say. They do not have the right to detain you in order to "investigate" anything. If they are POSITIVE that you have committed a crime, they (or anyone else) can "arrest" and therefore detain you.

                          State firearms law preempts local ordinances, but you'll probably have to spend some time in court to prove it.

                          Ex-Marines as mall security? Either they're washouts or stupid. EVERY ex-Marine I know that's tried out for LE agencies has made it.
