I never got an email acknowledging that they received my package or that the check was on its way. I had to constantly call the number to ask for updates.

I don't see why not. Take a look at the form. If I recall correctly, it doesn't indicate whether one is an original buyer or not. Unless you tell them.

Can you still request a refund even though it's kinda late in the game? I havent been active on calguns in awhile since having a new baby and work schedule has been hectic. I came on the other day trying to look for info on my poor looking reticle to see if it's normal and just read about all the lawsuit fiasco...I Sent it in 6mo ago for extreamly dim reticle, they warrantied it and was awesome. Put it away in my safe, and now I pull it out and the reticle is all grainy and crap looking..smh. (My eye sight is perfect as I get my eyes checked regularly) I really like eotechs, just this xps3.0 has been a lemon
