Thanks for the help everyone, I really appreciate your time for helping out. I wasn't aware that there was a five transaction limit per year and the penalties involved, so your posts likely saved me a lot of trouble. I'm still kind of up in the air about this. From the looks of it, I can still have up to five private sales per year. Over here LCPs sell for about $300, and from rsmorgan's post it looks like I could make up to $300 in profit from each gun. So even with the five transaction limit by law, I could make up to $1500 just from private sales. Also, with Glock's blue label program, I could get a Gen 4 17 or 19 for about $400. With the average prices of Gen 3 selling for about $500, I could probably make at least $200 selling a Gen 4, not to mention the three magazines I would be able to keep in my home state (I would replace them with new 10 rounders). If I were to limit myself to the legal five transactions and then stop, then it looks like this would be okay right? Even with the five transactions limit I could still get some decent pocket change.

Whatever you decide to 'bring with you'; don't even come close to 'fulfilling an order.' i.e. don't buy anything that someone has asked for. Thanks for the help everyone, I really appreciate your time for helping out. <joking> I thought he was just asking what would you buy if coming from out of state. If he gets bored with it and decides to sell it then I would buy it. </joking>I support the NRA, if you are not in, you can't win.

Find a clean, rust free classic car (Ca smog exempt) for around $2000.
Doesn't have to run, but body condition is important.
Rent a uhaul trailer and post it for sale for $4500.
You will make out quite nice for the right vehicle.
1972 and older Novas, Chevelles, Camaros, El Caminos....
This will keep you out of trouble with DOJ, ATF, Etc.
Opens a wider buyers market.
Hope this helps.Comment

Can anyone point out specific legal consequences like jail time or fine?
Thanks law abiders....
Its funny how only calgunners know this and is not mentioned by any gun store or anywhere else. Maybe this rule should be added as a disclaimer in the paperwork when purchasing guns/dros etcComment

Still up in the air about this? Seriously? Thanks for the help everyone, I really appreciate your time for helping out. Heres the thing, intent.
This quoted post and the original post clearly show your intent to purchase these firearms solely for the purpose of resale.
That is "engaging in business" which ATF clearly states you must have an FFL to do.
If you just happened to buy these guns and later decide that you didn't want them that is one thing. You would be disposing from a private collection, which is totally legal. But that boat has sailed and you can no longer claim that. BTW it is a known fact that the Alphabet Soup Guys watch this site.
What you are proposing is illegal under federal law without being a FFL.

Again, this is not a way to make a quick buck.Comment

Federally it is on the 4473.Can anyone point out specific legal consequences like jail time or fine?

Notice at the top of page 2 the large block of text. Read the last couple sentences
ATF FORM 4473 PAGE 1

ATF FORM 4473 PAGE 2

I do not know off hand if the CA PC "less than 6 transactions" law is posted on any forms. I'm 99.999% sure its not on the DROS worksheet. But ignorance of the law is not a defence against it.Comment

>from rsmorgan's post it looks like I could make up to $300 in profit from each gun
.. I thought he closed his thought that SSE would cap your profit at $100 per gun? So for five guns, you make maybe $500, but you also tie up $2500-$5000 in inventory during the period you purchase and hold the guns (unless on a credit card in which case you are getting charged interest)
SSE for an XDm I think cost me $125 over in-state cost (out of state transfer + SSE), and I got to pick exactly what gun I wanted when I purchased out of state and had sent here to Tracy Rifle for FFL/SSE.
As others have said, use your freedom of purchasing something to lock up what you want to own with less hassle then doing it after you get here.Comment
