Glad to hear it. Hope it helped.Showed the initial officer the Open Carry flyer http://www.paul.net/guns/CaliforniaOpenCarry.pdf that had the PC in it.
It's amazing that the LEO tried to state case law, that he can't cite (i.e. doesn't exist), makes what you are doing illegal.
And their attitude, although not surprising, is saddening - that YOU shouldn't have a gun, only WE (LEO) should.
You might want to post your story over on the open carry forums also.Last edited by MudCamper; 03-18-2008, 12:17 PM.Comment

Good for you for standing up for your rights - which can be difficult and not without a consequence. I would say you may have been lucky to get out without arrest.
I also figured what the LEO's told you is exactly what they would say: only police should have.., your looking for trouble..., your not trained..., what if an officer..., bla bla bla and more uninformed macho, only for us BS.
Also not surprised to hear most of them care less about the actual law and would rather just arrest you for their trouble in responding and sending the problem to the DA and a judge to figure out - typical from what I have experienced.
I think the "new law" the guy refers to regarding the definition of a loaded firearm only applies to possession of a gun and ammo on a person within the Capitol, and offices, and it is only a few years old - so he may be right here, however, the law defining only a gun with ammo as loaded is also new.
It may be a good idea to go down and see the sgt that informed the "crew" that it was legal to open carry, as he maybe he could help to educate the rest of the PD group.
To give some histiory, I understand OC+ loaded was legal back in the 60's - until the Black Panthers showed up at the Capitol for a demonstration with all sorts of loaded weapons and scared the skirts off everyone. Soon after the law regarding not allowing the carrying of loaded weapons in public was passed.
A movement to OC so this right becomes coomon practice and not a reason to be harased by the police would be great. However, I would assume the out come would be like above and a new law would be passed to ban any OC without a permit.Last edited by M1A Rifleman; 03-18-2008, 1:26 PM.The only thing that is worse than an idiot, is someone who argues with one.Comment

+100 That off duty cop still probably thinks he won by just causing so much of a hassle over it. You are over the hard part now and you should absolutely keep carrying until they accept that what you are doing is legal and even more importantly he only legal alternative to getting a CCW. Great job man. It is awesome that you kept your cool so well. I would have been very upset if they would have started making up case law like they did in your case.

Anyone else besides me send an email to the Manteca PD politely protesting the officer's actions, attitude, and harassment of a law abiding citizen who was breaking no laws?Originally posted by harmoniumsAbsolutely, I've refused sale before.

Thank you.
You got BRASS BALLS!!!! Thanks for taking one for the team and eduamacating them Manteca PD cops. Seems like they have some sort of ego problem with respect to PC laws about them being the only ones having guns. Yeah they should walk around town thinking that...oh that banger aint armed...cause Im the only one that is. What a posse of douches.
Glad nothing happened. You should write up your incident report and send it to their Chief to educate them.Comment

Key word is politely here. Dont send an email that is going to give the people of this forum and especially the OP a bad rap. You may in fact want to thank them for eventually upholding his right to open carry.

let's all send Chief Charles M Halford Manteca PD an email
Chalford@ci.manteca.ca.us
Asking him why his cops are not using their time and OUR tax dollars more wisely.
LEO's attitudes towards citizens owning/carrying guns is simply hilarious. They rarely if ever PREVENT us from being crime victims but are always there to take pictures, names, dates, descriptions, measurements etc. When PDs become proactive instead of reactive I'll have a different opinion/attitude.
Funny thing is they probably never leave home without their off duty piece, claiming to have a dangerous job. The fact is (according to LA County stats anyway) convenience store clerks and construction workers have a way more dangerous job than do cops (by at least 30%) so LEO's please spare me/us.Last edited by SONYEXEC; 03-18-2008, 2:31 PM.Armand

Would it not be better to communicate thanks for the Sgt's handling of the situation? If the now-educated officer repeats his error, then protest.

I figured that would go without saying. The email I sent commended said SGT for knowing the law and not succumbing to hyperbole.Originally posted by harmoniumsAbsolutely, I've refused sale before.
