I was under the impression this is fine also.I just did a PPT and the gun I bought had its original lock and they said that was fine. Also they didn't care if I locked it or not. They said I have to lock it before I leave the parking lot. So I hop in my jeep, and since I'm a law abiding citizen I pull out the lock and there's no keys!!! Go figure. I guess this FFL just don't care.Comment

The wording in the federal law just says "provided with" a locking device. Nowhere does it say it must be purchased. So if the person selling the gun gives a lock with it on a ppt that satisfies the federal requirement. My local police department offers free gun locks to residents which should also meet the requirement. As mentioned before, a printed or even hand written receipt should be enough evidence of you being "provided" a gun lock.Comment

For handguns, I either give my customer one of the Project Childsafe locks the SO gave me and have them return it immediately, or I operate a lock exchange program if they have a compliant one available to them (i.e., you provide me with one, I'll provide you with one for your new purchase). So long as people either give me one or bring the one I provided back, I'll always have one to spare for the next customer.
For long guns, safe affidavit all the way.
The law doesn't say I have to sell you a lock; it says that one has to be PROVIDED. You'd be amazed how much repeat business I get when people find out I'm not out to gouge them over $6.

As Librarian said.. it's the law that ALL guns come with a NEW lock.. so if new the one in the box counts.. if a PPT then you need to show one bought in the last 30 days (reciept) or buy one at the time of transfer.
FFLs that let you slide are technically breaking the law.
It's sad, but it's true.. Just print yourself a sweet little invoice on your printer. Not quite true. A new lock isn't required, if you fill out the safe affidavit. This fulfills the California requirement. There's nothing in the Federal law that requires a new lock, just that one must be provided with the gun. Also note, that there is no receipt within 30 days requirement for federal law.And they say gun shops spread FUD.. lol

This is in response to your letter to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). In your letter, you asked if the California State Form, Affidavit Stating Ownership of an Acceptable Gun Safe or Lock Box. is an acceptable form for customers in lieu of purchasing an 800+-pound full safe.
As you may know, a major mission of ATF is enforcement of the provisions of the Gun Control Act of 1968 (GCA), its subsequent amendments, and other Federal firearms laws. A significant part of the GCA concerns the requirements pertaining to the manufacture, importation, distribution, possession, and sale of firearms.
Section 921 (a)(34)(C) of Title 18 of the United States Code (U.S.C.) defines a secure gun storage or safety device as a safe, gun safe, gun case, lock box, or other device that is designed to be or can be used to store a firearm, and that designed to be unlocked only by means of a key, combination, or other similar means. 18 U.S.C. 922(z), regarding secure gun storage or safety device, states in part that it shall be unlawful for any licensed importer, licensed manufacturer, or licensed dealer to sell, deliver, or transfer any handgun to any person other than any person licensed, unless the transferee is provided with a secure gun storage or safety device for that handgun at the time of the firearm sales transaction.
The form used by the State of California Department of Justice with the standards set forth by section 977.50 of the California Code of Regulations may comply with California laws but does not comply with the laws and regulations set forth by ATF. This form is not an ATF form and is not an acceptable form in lieu of presenting a secure gun storage or safety device at the time of each firearm sales transaction.
