Wow, that sucks. Sorry OP. All I can say is that s**t happens and just roll with it. It might take twice as long but you're still going to get the gun. And its worth the wait.

    Could always be worse...

That's such b.s. unfortunately they're just going to tell you to pound sand. Not worth fighting city hall on this one.

Crap that sucks... I just put a 75B SA in jail on the 31st day too. Did they let you re-start it right away or do you have to wait an additional 30 days?

          I restarted it

I restarted it today. Time will tell whether or not the DOJ allows it to go through or not. But the guy didn't say we had to wait and I paid another $25 to start it again today. It does suck.

Well, what can you do when they are always right and you are always wrong....even when they can't count

Some FFL's change their rules from 10 to 11 day waiting period perhaps for this same reason.

Certainly hope it works out for you, but I believe it's going to be thirty days from the date of the denied DROS; you may actually be looking at starting again in mid May, since you filed another today.

Hope I've gotten it wrong, but that's my understanding.

              Good luck!

If you look at your paper work from your previous DROS, it will show the soonest you can DROS another gun. That's why I buy used/new guns from PPT. Don't have to think about that stupid 1 in 30 day rule.

I counted the days and the 30th day was on April 3rd. So just to make sure, I started the DROS on this CZ 75 SP-01 on April 4th which is the 31st day. And they denied me the pick up. Had to start DROS all over again today. The guy called me yesterday with the notice. Today he said it was funny because they usually call the very next day if not the same day to deny a gun DROS.

What do you guys think? Any recourse I can take?
Well that stinks! You may want to ask in the FFL forum if there is any remedy. You'll have to decide if the $35 and your time is worth pursuing any possible remedy. I don't see the DOJ sending you a check for $35, though.

You would think that the guy at the gun store would know about those rules too? Right? I hope I didn't go down there and cost myself another 30 days. That is going to suck. I looked on the DOJ website and didn't find anything about that.

You are wrong about the 30 days starting over from the date of denial. It is still just one firearm per 30 days, and they let me pick up my CZ 75 SP-01 today. They said the other one they had sold to another guy from Redding. He might have seen this thread where I stated the gun store had one more in stock.

Anyway, I just wanted to let people know that there is no penalty for being denied. At least not yet. The guy at the gunstore told me that the State is trying to pass legislation that will make it a misdemeanor to attempt to purchase a second gun within the 30 day limit.

Last week a guy at Turner's told me they were backordered at all locations. He said they would do a pre-order but they won't be available for 2-3 months.

I just searched all around and found a hard to find SP-01 within driving distance of my house. But I wasn't so lucky when looking for the even more elusive CZ 97B. But I did find one at a gun store called Triple A's Sporting Goods in Vallejo CA. They are only charging me $20 to ship it to my gun store here in Redding. Give them a call, they just might have a CZ 75 SP-01 in stock also.
