Yes that's the word, "UNINTENTIONAL". The prosecuting side will try their best, so stick to your guns that you fired because you felt your life/love ones were in danger. You fired to stop the threat with no malicious plan in killing anyone. Wear your Sunday clothes to court. That punisher shirt is not a good idea.

It doesn't matter if you shoot an intruder with a box stock or Tier X custom weapon with a sub pound trigger. You will go to court if DA or family of scumbag files charges. If you go to court just imagine how much legal fees you'll be faced with. Even if you skip jail time you'll feel it in your pockets.

Eh, not entirely, if someone is truly acting within the law a half decent attorney can settle your criminal legal troubles for the price of a new pistol. If it is a civil case from the family California law can compel a plaintiff for pay legal costs if the case is dismissed in summary judgement, which it would likely be with the stipulation to the shooting being intentional, therefore lacking in negligence.

The layman's misunderstanding of legal issues can only be surpassed by their self assurance that they do indeed understand legal issues.

I am glad it got you to thinking. The ND could have killed somebody.

What if I was on my way home after a day at the action pistol range and I see a San Bernardino type of terrorist active shooter. If I go into action and neutralize the threat with my custom competition guns with 1.5 lb trigger pull, high cap magazines, souped up reloaded ammo, would they prosecute me?
If you shoot a bad guy you are a hero. But what if you shot the wrong person? Or deploying your weapon you have a negligent discharge and hit a bystander?

. . . and that the shooter was acting pursuant to a reasonable fear of imminent death or great bodily injury, which would take the "wrongful" out of any "wrongful death" suit.

By the way, it's good to see some sanity returning to the ranks of California gun owners.

Yeah, there is. And this thread seems to come back in some form once or twice a month.

Same two sides with same arguments every time with both sides claiming their opinion is right with no hard evidence for either side.

That statement alone is likely far more detrimental to one's defense than anything else could ever be.

Well first of all I wouldn't want to shoot anyone unless I have to for the safety of self and family. I sure wouldn't be using any gun that can paint me I a bad light. With the price lawyers charge that's one pricy gun.

If you ever have to shoot someone in self defense politely invoke your 5th amendment right and request an attorney. They will be able to help you articulate correctly what facts lead you to reasonably believe you were in imminent danger of death or great bodily harm.

We see this confusion when people think using an AR-15 for home defense would be less explainable than something less "scary looking" than say a .22 revolver.

This is not how it works though, the legal analysis for the justification for the use of deadly force remains the same whether you use a modified firearm, AR-15, or a .22 revolver. If it is justifiable to shoot someone with a .22 pistol it is also justifiable to shoot them with an AR-10. Same goes for modifications to the weapon.

Once again, this changes if the weapon is discharged UNINTENTIONALLY. In that case you may be seen as negligent in your modification of the weapon's firing system, and for violating a fundamental rule of firearms safety because you failed to keep your finger off the trigger until you are sure of your target and ready to fire.
Finally, someone who understands the issues.

Here is how to modify your trigger for your HD weapon.

Get new gun. Buy mucho ammo.

Clean and lube up new gun (leave copper anti-seize on the Glocks).

Run mucho ammo through new gun = best trigger job!

Everything run without a malfunction? Yes - Clean, lube and Carry HD gun.
