      Sheriff Smith is being indicted for:

      Count 1: Illegally issuing concealed carry weapon permits (CCW) to VIP’s
      Count 2: Failing to properly investigate whether non-VIP’s should receive CCW permits
      Count 3: Keeping non-VIP CCW applications pending indefinitely

      Count 4: Illegally accepting suite tickets, food, and drinks at Sharks game
      Count 5: Failing to report Sharks game gifts on financial documents
      Count 6: Committing perjury by failing to disclose Sharks game gifts
      Count 7: Failing to cooperate with internal affairs investigation surrounding treatment of Andrew Hogan


      Will Smith continue committing #2 and 3 above now that she’s been formally accused? Or will she now start processing and investigating all those pending applications? It’s been a week and I don’t notice any changes on her CCW webpage:


      Three weeks until her first day in court! I hope the first question the judge asks her is “Have you ceased counts 2 & 3? And if not, why not?”

        I assume she’ll fight rather than resign. But doesn’t that run the risk that they might uncover something during her civil trial that might aid the criminal grand jury? Better “to fold” at loss of job now rather than risk increasing the odds of becoming a defendant in a criminal trial later?

              Laurie is going to court this morning;



              SANTA CLARA COUNTY, Calif. (KRON) — Santa Clara County Sheriff Laurie Smith is set to appear in court on Friday morning on misconduct charges.

              The court session is likely to be brief. She is expected to contest the charges against her. The hearing will take place virtually over Zoom around 10 a.m

              Smith and her legal counsels are expected to answer to the accusations. She has been indicted for willfull and corrupt misconduct in office.

              Three of the charges center on allegations that the sheriff granted licenses for concealed carry weapons to people who contributed to her campaign or are prominent in the community.

              Three other charges focus on a San Jose Sharks game the sheriff attended in February 2019.

              She allegedly received free suite tickets, food and drinks exceeding the $500 gift limit. Court documents say she failed to disclose those gifts.

              The seventh count accuses her of failing to cooperate with an ongoing investigation surrounding the treatment of an inmate.

              Smith has been in office for 23 years. Following the indictment, city and county leaders are calling for her to step down.

                Rather than deny or admit the civil grand jury’s accusation, Smith is challenging the accusation. She also waived her right to a speedy trial. Next stop is a status hearing on March 15.

                  I have little faith in the voters of Santa Clara county if she is on the ballot for reelction. They are brain dead enough to still vote for her.
                  Limit politicians to two terms. One in office and one in jail.

                    The voters cannot keep her off of the ballot if she wants to run again, they can only choose to vote for her or not (not vote at all or vote for someone else).

                        If you SCC gunnies want CCWs you’d better step up, get involved, get organized, get active and make it happen. Be men and don’t leave it to chance or the federal courts. (No, I don’t live in SC Co.)

                            When is your “next time”: 2022? 2026?

                            Re 2022: Smith is not pleading one way or the other, but rather attacking the foundation of the indictment. She’s waived her right to a “speedy trial.” The news report said the judge has “30 volumes” of information to review. But the sheriffs election is 2022 June 07, just 142 days from now. I’m saying don’t count on Smith being convicted before then.

                            Re 2026: she’ll be too old to run again, plus she’ll probably be challenging an incumbent sheriff, plus her conviction may bar her from qualifying for the ballot.
