    I hh8 a govt that make clerks afraid of losing ther license if they fail to spot a strawpirchase/ its one thing to be knowinlgy selling to prohibited persons via the straw purchas method its another thing to have to scrutinize your customer a little bit/
    STILL it SUCKS they have to be put in this place by an arms fearing Govt

    Did the op say when she wen tback yet?

      The sad truth is that they get taken advantage more then guys do. My wifes daughter got taken at the dealer. window switch was broken. Went in got it fixed $275. 3 weeks later its broken again. They looked at it and claimed something was not cleaned on the contacts. They made her pay another $120. I told her she shouldn't of paid anything and I was willing to go down there with her and demand all her money back. She did not want to because one of her friends works there. I just shrugged. i know when I am told to butt out. She is out $400 and her windows still do not work right.
      So yeah there is still sexism out there but I don't think this was a case of that. i think it was a cautious clerk.

        Oh, I know. That's why I'm willing to go along with them. But for something like a firearm purchase when they already know exactly what they want and how much it's going to cost? They don't need someone present for that. There's a difference between "Give me that one" and having a half hour conversation about fees, whether or not work needs to be done, etc. No different than going to Macy's and buying whatever, there's no negotiating to do.

        There are times to take a guy along, and times where it's not needed, it's not needed at big 5.

          I think it was all a misunderstanding. When I read the OP, I immediately thought that the clerk had probably suspected a straw purchase - I'm glad to see that so many other people chimed in on that.

          As for me, I can do my own gun deals and don't take a man with me as I don't need "help". I figure that, if I'm a big enough girl to own a gun, then I can put on my big girl pants and go to the shop by myself.

          When I went to DROS a handgun earlier this year, my conversation with the clerk came around to the point that I had come in alone. I told him that I hadn't considered bringing a male friend because that's not how I roll. He said something to the effect of, "I noticed that you hadn't brought any men with you; that's a good thing because it would have worked against you if you had."

                  I don't think it was gender discrimination. I had a similar thing happen when my wife was looking at a gun and I said I wanted to be on the DROS since we didn't have my wife's registration with us. I said it would effectively be a shared shotgun so it didn't matter, but the moron (I call him that for a long list of reasons - I don't much like the Hemet location) said that since my wife was the first to show interest in it, he would only DROS it to her.

                    Uhh, you just described a straw purchase. She was going to buy a gun, then you were going to do the paperwork for it because she didn't have the ability to do so at the time. Not quite the same as if you had said you were buying it for her as a gift. The clerk isn't a moron just because he/she was trained to turn down your purchase for the exact reason you described.

                        Negative. Marriage also doesn't matter for purchase except for the ability to do intrafamilial transfers without having to do a PPT, but that's not what you described either.



                        Now you did mention that you could just gift the thing, but that was already after he suspected a straw purchase and as such refused the sale like the DOJ and ATF tell him to.

                          Yes, but that would still mean you buying and DROS'ng the thing yourself, and then handing it to her.

                          Not her trying to buy it, realizing she can't, and then you buying it for her instead. The laws are stupid, but that's a straw purchase. Even if you explained the IT part afterwards, you didn't do that to start with. The clerk has probably had it drilled into his head to tell you no and not go through with the sale. Like I said in that thread and this one, blame the DOJ and ATF, not the clerk who has to deal with paranoid management not wanting to lose their FFL.

                          And I already said the marriage only matters for the IT, so I'm not sure what you hate breaking to me, considering you weren't doing an IT.

                            I think this post has had its day.

                            I love big 5 for my mosin madness hits but the clerks are usually kids (some of them my former students who blanch as I buy a rifle or ammo

                            I think big 5 is a great retailer; I think sometimes straw sales come in; I don't think I expect guys who sell socks or hiking boots all day to call a straw sale accurately at the end of their shift.

                            I don't like sexism and i would call the manager and make sure this is registered.

                              Don't argue with me, I let you know who identified what you wanted to do as a straw purchase, and considering who it is I'd take his opinion. The difference between a husband and wife trying to make a straw purchase and doing a normal IT transfer is subtle, and after you already spooked the clerk into thinking it was a straw purchase he probably didn't want anything to do with you at the risk of his job. Don't get mad at me, or the store clerk for that matter. Be angry at the government agencies that strongarm these store owners into that sort of paranoia.

                              Straw purchase:
                              "Hmm, I can't fill out the 4473 because of <insert reason here, even if not prohibited from owning firearms>, can you fill this out for me dear?"

                              IT
                              "I'm buying this as a gift for my wife, I'm going to fill out the 4473 myself and then give it to her later"

                              Is the intent the same? Yes. But they're still different.

                                If it did seem like a straw purchase then the Big 5 employee should of known it obviously couldnt of been what it seemed like if your BF did the DROS paperwork. And even if it was a straw purchase the seller isnt responsible for anyone else as long as the DROS goes through ok. Whats the address of this Big 5 so I wont go there.
