I agree with Kemasa, that its probably time for an attorney, however I would feel like the plaintiff here would be our customer, as we have not incurred any financial loss here. Unless we could prove we lost a sale because of this, but its not like the customer would be able to go elsewhere and purchase another firearm without obtaining another FSC or getting a replacement from us.
What is the issue here is in the PC as stated above, the department is the one who is in violation of PC 31660 by not allowing the customer to obtain a replacement FSC for the $5 as required by law and adopted in the emergency regs.
As usual I am willing to provide any documents necessary for any attorney who is willing to take up the case and file a complaint against the DOJ in this matter. I will be willing to speak with them and provide anything they need in their discovery process. I would find it hard to believe that this is the ONLY time somebodys information has been lost by the DOJ. I guess that if this happened to our customer there are others who just didn't realize it. Here we were willing to search and find everything for the customer because we are a small local shop. I doubt big box retail places like Bass Pro or Turners would have been able to find this problem and would have just told the customer to retest and pay another $25.00.
