how do you or can you register a trapper

I am a FFL, my post was moved yesterday to the how law applies to me section, but i dont need a bunch of "customers" telling me the letter alone makes it legal so it really does need to be in the FFL form.

CAN I, and HOW CAN I register a trapper (15" barrel rifle with a letter from ATF stating it is a NON NFA ITEM and a C&R gun).

Anyone have any incite on the FFL side?

Mods deleted our thread too about the Franklin Armory thing no PM or explanation why. I thought this was kind of BS to delete that thread too since we actually had a customer asking an employee at another shop who reached out to us for advice and we in turn brought it to calguns. I guess its possible CG is gearing up for a lawsuit and doesn't want this discussion on a public forum, but I wasn't happy when I went back to read the tread to discuss with the guy who called me about them in the first place.

Thats what I am tracking. I dont know how a 15" gun can be legal PC12020 says anythign under 16" is SBR. Not that NFA is illegal, no thtat C&R are exempt, ect. Thats why I was upset it was moved to the other thread, because non FFLs look at things different. I got yea sure its legal blah blah but when you ask how to register it they have no clue lol

Wrong. Once the Feds reclassify a SBR into C&R it then becomes a C&R in the eyes of CA. Been there...done that.

I don't know how to register it in the DES, but 12020(b)(7) allows possession if properly registered per the NFA. Here's an older thread on it...

Do you want an AOW or C&R SBS/SBR in CA?

Well, if you look at the CA penal code, there are a couple exemptions to the AOW/SBS/SBR prohibitions in 12020. A couple of the 12020 exemptions do not require CA DOJ permission to acquire an AOW/SBS/SBR, just Federal NFA permission. If we follow the pertinent code (cleaned up to remove non-relevant code) regarding short barrel shotguns and rifles, we see the following:

Except as expressly provided in Section 12020, and solely in accordance with Section 12020, no person may manufacture, import into this state, keep for sale, offer for sale, give, lend, or possess any short-barreled shotgun or short-barreled rifle, as defined in Section 12020, and nothing else in this chapter shall be construed as authorizing the manufacture, importation into this state, keeping for sale, offering for sale, or giving, lending, or possession of any short-barreled shotgun or short-barreled rifle, as defined in Section 12020.

12001.5 basically state that SBS/SBR are illegal unless allowed per 12020.

(1) Manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, lends, or possesses ..... any cane gun or wallet gun, … any firearm which is not immediately recognizable as a firearm, any camouflaging firearm container,… any short-barreled shotgun, any short-barreled rifle ..... any unconventional pistol

12020a basically reiterates that AOW/SBS/SBR are illegal with the following exemptions.

(2) The manufacture, possession, transportation or sale of short-barreled shotguns or short-barreled rifles when authorized by the Department of Justice pursuant to Article 6 (commencing with Section 12095) of this chapter and not in violation of federal law.
(7) Any firearm or ammunition that is a curio or relic as defined in Section 478.11 of Title 27 of the Code of Federal Regulations and which is in the possession of a person permitted to possess the items pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto.
(8) Any other weapon as defined in subsection (e) of Section 5845 of Title 26 of the United States Code and which is in the possession of a person permitted to possess the weapons pursuant to the federal Gun Control Act of 1968 (Public Law 90-618), as amended, and the regulations issued pursuant thereto. …. The exemption provided in this subdivision does not apply to pen guns.

12020b lists exemptions to the prohibitions in 12001.5 and 12020a.

Once the proper documentation is obtained from BATFE declassifying a SBR
to Federal C&R I submitted form BOF 961. It was accepted.......
I can't explain any more than that.

Form BOF 961 is the Collector In-State Acquisition of Curio or Relic Long Gun Report.

Now if that is the case, how do you register it once it is transfered in? lol Thats why I posted in the FFL forum.
