    Parking ticket question

    Hey guys I have a question for you and would be grateful you guys could give me an answer.

    My buddy just texted me that he accidentally parked in a handicapped spot at the mall.

    He overheard mall chatter over the radios that they were going to give a ticket to his car. So he went to his car and left the mall before they ticketed the car. Can they still give him a ticket?

    Does the car have to be present for them to issue one?

    This is pretty dam funny imagining him running through a mall to escape a ticket haha.

    Mall security can not cite the car, there is a couple of big battles going on now about that in Emeryville and I think the other is SF, where private security is citing vehicles with no authority to do so. Emeryville has gone to court last I heard and had a cease and desist order issued on it.
    Only PD employee's or volunteers can cite vehicle code violations. So to answer your question he's good. Although I'm curious how someone could accidentally park in a disabled spot, they do mark them pretty well.

      Thanks for the answer, I just asked him myself and he said he saw white lines so he assumed he was good. Maybe it was fading? He certainly isn't the kind of guy to do that on purpose

        Lol, I don't think it was "accident" to park at disable parking. Anyway rented mall cop can not issue citation

          Most likely he was kid pretending to limp on the way in and ran out of Radio Shack when the tow truck was called.

            So, he accidentally parked in the handicapped spot but somehow put together that it was his car being referred to on the radio?

              Good point, just asked him and said they mentioned the bumper stickers he had lol

                Being illegal or improper under the law has never stopped crooks from trying to cash in whenever possible.

                This was on local LA news several months back.

                A security company has been issuing parking tickets that may be fooling drivers, according to CBS2 investigative reporter David Goldstein.

                    Parking enforcement could send him a present in the mail if they checked sent by mail, check box.

                      But it wouldn't be enforceable right? A police report would have to made made with evidence provided...correct?

                        Once I pulled into a parking lot and Granted, I am not a LEO, but I was a Code Enforcement Officer (or CEO as I like to call myself ) and I caught some fool parked in the handicap right in front of Carl's Jr. while he ran in for his lunch. I took photos of his vehicle clearly in the wrong and once my camera was away and I started writing, the guy came out and I asked him where his handicap placard was. He got in my face and asked me if he looked like he was handicapt. Mad dogging me and everything, then he told me to go eat a dick.

                        SO, after flipping me the bird and driving off, I finished my cite and wrote DROVE OFF on the bottom, I also included the lines on the bottom "Sent Via certified mail, Postal Form 3811" which is the green card folks gotta sign. His daddy signed for it but they did not pay. The fine did the usual double + $11 so it ended up being $551 when they ignored it. Then about a year and a half later I saw the same vehicle getting towed for 4000a or lack of current registration. I usually towed for that but I used CVC 22651 O. I put one and one together and the ticket agency put a hold on the vehicle reg and then it was towed for not being paid after 6 months.

                        Had he not been such a prick or thought he was gonna be slick he would not have had that $1000+ fine to pay... And it was just a chevy blazer too. So keep that in mind when you start doing- I mean when your friend starts doing things like that...

                          If a parking violation was committed in the presence of the parking enforcer, they could write the ticket and leave it on the windshield, or if they drive away just send it through via us mail. Either way it will get processed, no police report is needed just a quick paragraph on the back of the ticket.

Mall security can not write parking tickets for vehicle code violations, nor can they call in and have a cite issued on their say so without it being observed by someone authorized to write it. They can have a vehicle towed out of a disabled space on property they are responsible for. Clearly based upon the op mall security was either going to have it towed or call pd to cite.

                              This came up at dinner tonight. Under what authority code could anyone remove a parked vehicle from a handicap space? My limited knowledge of the CVC is that the CVC provides removal for abandoned vehicles, vehicles where the driver was arrested, and unregistered vehicles. I do not recall seeing a handicap designation code for being able to tow especially from private property.

                              UNLESS there is a way to use a 22658 A 1 to remove it, I am unaware of any other codes. Please educate us because this is good stuff to know.
