Parking ticket question

    22652 CVC authorizes LE to remove a vehicle from a disabled stall, public or private property. For mall security or a contracted tow company to tow off of private property, the section is listed on the signage posted at entry ways. I can't recall it off the top of my head at the moment.

      Interesting, but since you can never tow a car that's not there....

        Only PD employee's or volunteers can cite vehicle code violations. So to answer your question he's good. Although I'm curious how someone could accidentally park in a disabled spot, they do mark them pretty well.
        It can happen. I almost did it last week.

        It was dark, and raining. I was in a store parking lot, saw a car backing out of a spot that appeared to be next to a bunch of handicapped spots. They all had signs in front on the spots indicating they were handicapped. This one didn't. So I pulled in and parked. Again, no sign in front of the space, but signs in front of the others. Just to be safe, I walked around the back of the truck to look for a ground marker. Sure enough there it was. I couldn't see it because of the puddle that was over it, and there wasn't a sign. So I backed out and found another spot.

        I was very close to parking in it by accident.

          The same has happened to me. I check all around if I am parking near a handicapped spot just to be safe.

            22658(a) is for private property towing, I read all of 22658 and can't find anything specific to handicapped stalls . Anytime back in my days of driving a wrecker and I towed from a handicapped stall it was under the basis that though they did not have a handicapped placard or license plate, they also were not a resident of the complex per the management and did not have a parking permit.

                Since disabled parking has blue lines and I don't believe blue fades to white, I'm having a difficult time following that one.

                Also, SonofWWIIDI, unless things have changed since I left patrol, the sign is also required in addition to the proper markings on the parking space itself. So technically, I believe a ticket would have been invalid, but you did the right thing by parking elsewhere, so kudos.

                Disabled parking was my pet peeve and I always cited for it, even when working a criminal car. Frequently, while recovering from one of my many work related surgeries, I would not be able to park in a disabled spot because someone without the proper signage or plate would be in it. They were too lazy to park in a non disabled spot.

                The real question OP is; how did your friend hear the mall chatter. Does he take a radio with him when he parks in the disabled spots so he can hear if they are coming for his car.

                  I'm assuming that it was once a white parking spot that later got changed to a hand I capped one. I've personally news it multiple times. Also, no he doesn't haha he just overheard it from someone else's radio. They are pretty loud.
