Drinking ANY alcohol and driving is stupid. Trying to ride that fine line and still do it "legally" is asking for trouble.

DUI's on bicycles were fun for me.... I have arrested a few in the past. DUI's were a pet peeve of mine in general.... DUI's are 100% avoidable... Accidents caused by impaired driving should never happen. With all the cab companies out there and towing companies, which give discounts!Comment

I was once hit by a guy on a bicycle while driving. He rode right into the side of my truck bed while he was making a right hand turn (I was going straight).
I stopped and helped him up, he was uninjured, no damage to my truck, and we went our separate ways.
Guy was drunk, but I couldn't believe he didn't see me. Blew me away.

Fail 1: You should know your body and know when you're impaired. If you cant tell, get a cab or DD.
Fail 2: Submitting to Field Sobriety Test. Of course, if you are really DUI go ahead because you deserve the outcome.Comment

Having said that, most of the time I do field sobriety tests on someone and they end up being less than .08, I don't see enough signs/symptoms of impairment for me to form the opinion that they are so impaired that they could not safely operate a vehicle. Occasionally though, I do, and they go for a ride to county for DUI even though they are under the .08 level.
The only time I do FSTs is if I have reason to believe impairement. If they dont give me a chance to see a lack of impairement (and therefore are free to go) then they get arrested for DUI. But hey, go ahead and refuse, makes my job easier and the report a whole heck of a lot shorter.Urban legends are a poor basis for making public policy.Comment

I take it you're not a cop, and didn't read the forum rules, and are thus now giving bad advice. Just so you know, someone can be arrested for DUI even though they blew .00 and refused the SFST.

PST... Refusal to take a Preliminary Alcohol Screen Test, or Field Sobriety Test is a ticket to jail, where they will, by force, draw blood! Just an FYI...Comment

Thats cool. Dumb, but hey, whatever floats your boat. Keep in mind bail and impound fees are non-refundable, nor are lawyer fees.
