      Drinking ANY alcohol and driving is stupid. Trying to ride that fine line and still do it "legally" is asking for trouble.

      Beyond that,, all the technical info given above by my fellow LEO's is spot on accurate.

        DUI's on bicycles were fun for me.... I have arrested a few in the past. DUI's were a pet peeve of mine in general.... DUI's are 100% avoidable... Accidents caused by impaired driving should never happen. With all the cab companies out there and towing companies, which give discounts!

          DUI

          I set my limit at 2 beers if i'm out for dinner. If i have a third beer it is time for a cab, 40.00 cab ride sure beats a DUI anytime

              you can be arrested but the DA will most likely throw it out and if it does stick it would most likely be charged as an infraction any attorney can get you off the hook if you are under .08

                Fail 1: You should know your body and know when you're impaired. If you cant tell, get a cab or DD.

                Fail 2: Submitting to Field Sobriety Test. Of course, if you are really DUI go ahead because you deserve the outcome.

                  Having said that, most of the time I do field sobriety tests on someone and they end up being less than .08, I don't see enough signs/symptoms of impairment for me to form the opinion that they are so impaired that they could not safely operate a vehicle. Occasionally though, I do, and they go for a ride to county for DUI even though they are under the .08 level.

                  The only time I do FSTs is if I have reason to believe impairement. If they dont give me a chance to see a lack of impairement (and therefore are free to go) then they get arrested for DUI. But hey, go ahead and refuse, makes my job easier and the report a whole heck of a lot shorter.
                  Urban legends are a poor basis for making public policy.

                    I take it you're not a cop, and didn't read the forum rules, and are thus now giving bad advice. Just so you know, someone can be arrested for DUI even though they blew .00 and refused the SFST.

                    Just don't drink and drive. There's no reason for it.

                      Not giving any advice, that's my opinion. Good luck getting me to do any FST's or blow into the tube before you arrest me, take me to jail and we'll sort it out in court.

                          PST... Refusal to take a Preliminary Alcohol Screen Test, or Field Sobriety Test is a ticket to jail, where they will, by force, draw blood! Just an FYI...

                              Thats cool. Dumb, but hey, whatever floats your boat. Keep in mind bail and impound fees are non-refundable, nor are lawyer fees.
                              And, if thats the breath/blood test you are refusing, then your license will autmatically be suspended per the DMV regardless of the actual alcohol content of your blood.
