    Arrested but never convicted

    I was arrested and charged with felony possession of narcotics and misdemeanor petty theft a little over 5 years ago back when I was a young idiot. The judge dropped both charges and I was on my way. Other than that, I have nothing else on my record whatsoever. Not even speeding tickets.

    I've made my first firearm purchase today, and have read that arrests leading to no convictions can delay/**** up the Background check process.

    Has anyone had any experience with this? I don't fancy the idea of screwing around with the DOJ and filing a whole bunch of paper work resulting in a long drawn out process.

    Please let me know your advice/expertise.

      That would likely be a problem for CCW.
      For purchase? Toss a coin.
      Unpaid parking tickets can cause problems.

        If it was just an arrest and there was no conviction, you're probably good to go.

          If the Judge and the court did their jobs and closed your court record with the dismissal, then you should be GTG. If not, DOJ will advise and back to the courthouse for you to get the documentation updated . . . good luck!

            The court should have entered into the system accessed by the DOJ the disposition of your charges. This may well delay you, but the delay may be short lived if that dispostion was entered. If nothing about the disposition was entered, the person assigned to follow up on the charges may never get to them during the 30 day period following the commencement of DROS. If they do not, your status will change to undetermined and then your dealer may or may not deliver depending on their policies. If they do not, you may be able to sue them. See the link provided above. If it was me and it isn't terribly difficult, I would order a certified copy of the disposition papers from the court if the dealer tells me they will not deliver to an undetermined.

              Thanks for all the insight. Really hoping it's doesn't come to having to go back to the court and blah blah blah.

              Its only day one and I'm already dreading this. Lol. Hoping the next 9 days go by fast.

              Anyone know how long it actually takes the DOJ to approve/disapprove? It can't actually take them 10 days..

                You are not allowed to pick up until ten 24 hour periods have passed. Some places make you pick up on the 11th day. Denials can happen at any time the DOJ thinks it has discovered grounds to disapprove. They should not deny because of an arrest unless they also have documentation of conviction. You can't even find out why you are being delayed.

                  I have passed a Federal CHRC (Criminal History Records check) and STA (Security Threat Assessment) which involves fingerprinting due to my job at an international airport where I have full access to restricted air side areas. One of the requirements of this was to have no convictions of Felony narcotics possession.

                  Wondering if the people at the court did correctly file my case as this was sure to have come up during the background check process about a year ago...

                    If a disposition of dismissal was entered, as it should have been from what you say, it may have came up during your background check but not have been a disqualifying factor, since you say the requirement was "no convictions of Felony narcotics possession."

                      No, having a felony conviction involving:

                      "(ix) Illegal possession of a controlled substance punishable by a
                      maximum term of imprisonment of more than 1 year"

                      Meaning it would be been a disqualification for my federal check. Obviously DOJ is state and a completley different system though.

                      Anyway, Just called the Bureau of Firearms and talked to the person in General Information and he said that an arrest for narcotics possession but no conviction would delay my DROS. He didn't sound too sure.

                              I was arrested in 2001 for illegal BS AWB stuff. Oh, and a blow gun... (LoL) Total of 4 Felonies and a Misdemeanor.

                              After getting EVERYTHING thrown out in court, I have purchased many firearms since. Even considering a rifle in AZ (never seen that type of .22lr anywhere else before) ... I do think about it all the time, but less and less the more firearms I buy.
