We're about 1/2 thru May so I thought I'd ask if anyone knows if there's been any news re. mediation in the Nordyke case.

Mediator reported to the en banc court that mediation was not fruitful about two weeks ago.

I know the courts move at their own pace...but Good Lord Almighty this case seems that it will never reach a conclusion...much less one favorable to the Nordykes.

I bet it went something like this:

Alameda- you win but I don't want to pay you.

Don Kilmer- I don't think so.

I thought the "two weeks" only applied to the future. Guess the time axis is reversible after all.

I am shocked, shocked, I say.

I'm sure the court was happy to hear that....

Thanks, I hadn't heard that. What does this do to the timeline? (anybody that says two weeks will be shot in the face with silly-string)

Well, Kozinski's looking rather wise right now. As I recall, he wanted no part of sending this to mediation. I thought that made them look foolish, after 12 years of litigation, 2 en banc panels and so many unresolved differences.

The Second Amendment is the one right that is so fundamental that the inability to exercise it, should the need arise, would render all other rights null and void. Dead people have no rights.

So this will push back Pena v. Cyd?

Petitions to lift the stay in Pena, Peruta, Scocca, etc. would seem prudent as other cases by other groups could advance ahead to set bad precedent.

Since the 9th is making it crystal clear that they do not feel the Nordyke case is in any way about the 2nd amendment, can we PLEASE have the stays lifted in all the other cases being held up by Nordyke?

Laws that forbid the carrying of arms...disarm only those who are neither inclined nor determined to commit crimes...Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.
