The original poster needs to update the title of this thread to include the latest judicial developments.A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
The Second Amendment makes us citizens, not subjects. All other enumerated rights are meaningless without gun rights.Comment

Here is practical question on “sensative area” I have no idea where to ask opinion. My friend works for MTA. This is partly funded by federal government. He is parking on MTA parking lot. Does this conceder federal property? Can he keep his CCW in locked container there? I understand this is not legal advise, just asking opinion.sd_shooter:

Just my amateur opinion, but I think he's OK. I'm not aware of a restriction on federal property in general (except USPS and staffed federal offices IIRC). There's the "common carrier" prohibition and I've never been 100% clear on that. Does it apply to subways, Metro, City busses? I'm sure it applies to Amtrak. But, your friend isn't getting on the train, so that would not come into play. And this is all for actual CCW. If he's got it in a locked container, that's even better. Here is practical question on ?sensative area? I have no idea where to ask opinion. My friend works for MTA. Now... The MTA might have a policy against bringing a firearm on the property (they likely do). So he could get fired or possibly even have an incident where the IA pulls his permit.Last edited by GetMeCoffee; 01-08-2024, 8:47 AM.sigpic

However, CA PEN 171.7 reads:Whether Section (a)(1) includes employee parking is anybody?s guess. But, if it does, there is no exception for employees.171.7 (a) For purposes of this section:
(1) ?Public transit facility? means any land, building, or equipment, or any interest therein, including any station on a public transportation route, to which access is controlled in a manner consistent with the public transit authority?s security plan, whether or not the operation thereof produces revenue, that has as its primary purpose the operation of a public transit system or the providing of services to the passengers of a public transit system. A public transit system includes the vehicles used in the system, including, but not limited to, motor vehicles, streetcars, trackless trolleys, buses, light rail systems, rapid transit systems, subways, trains, or jitneys, that transport members of the public for hire.
(2) ?Firearm? has the same meaning as specified in subdivisions (a) and (b) of Section 16520.
(b) It is unlawful for any person to knowingly possess any of the following in a public transit facility:
(1) Any firearm.Comment

My understanding is the case will be heard by the merit panel in April.
We have at least till then to be free.
Then the case will be heard by the merits panel and a ruling will be forthcoming. I'm not too concerned about the merits panel.
I think we will get some kind of compromise/split decision, but the worst will continue to be enjoined.
It's after that I'm worried. The ruling will then be heard by the en-banc panel and that's where things could get bad.Comment
