    AB 1297 McCarty - remove cap on CCW license fees



    Existing law authorizes specified local law enforcement agencies to issue to an applicant a license to carry a concealed firearm if certain requirements are met, including, among others, that the applicant has good cause for the license. Existing law requires an applicant for a license or a renewal of a license to pay a fee to the Department of Justice, as specified, to cover costs associated with background reports. Existing law allows the licensing authority of any city, city and county, or county to charge an additional fee for a new license in an amount equal to the actual costs for processing the application for a new license. Under existing law, that additional fee may not exceed $100.

    This bill would require, rather than authorize, the local licensing authority to charge the fee and would require the fee to be in an amount equal to the reasonable costs for processing the application, issuing the license, and enforcing the license, as specified.

    The bill would delete the prohibition on charging more than $100 for the fee.

    this is the same asswipe legislator that authored AB 424 that took away school officials' discretion to allow concealed weapons on THEIR campuses.

      Easy suit based on economic/racial bias. Minority applicants would be affected more by this.

              By then Excremento will have passed a series of oppressive gun laws, each having at least a 10 year lifespan before being overturned.

              For every unconstitutional gun law overturned, 5 more are passed to replace them. All of them are allowed to be in effect until overturned, if at all.

                I think this is the appropriate board to post this to.

                AB 1297 removes the cap that a licensing authority can charge for a concealed carry permit, thereby potentially increasing the cost to obtain a permit exponentially. This would price out all but the rich and well-connected when it comes to CCWs, leaving no legal option for self-defense for those not as wealthy or elite.

                    Once passed and yes I'm positive it will I see the fees in the PRK rising to a "reasonable" minimum of at least 2k.

                          The first part does put a cap on it, which could be easy enough to sue if they tried to overcharge. Processing and issuing can be measured. However, the "enforcing the license" means whatever they want it to mean, including funding an entire police department. So they have given themselves an out to allow no maximum, and charge whatever they want.
