NRA/CRPA demand letter (first step of lawsuit as plaintiffs) to CA DOJ on BB AW regs.

      See calgun thread here: http://www.calguns.net/calgunforum/s....php?t=1290256

Now is the time to send money in to the CRPA and NRA to fight this.

We can thank our pals at Michel & Associates for those

Looking at the letters, they appear to echo what the more optimistic of us have been saying. Hopefully we'll see less pessimism around here for a while now (ya right)
Settle down, folks. The new "ghost gun" regulations probably don't do what you think they do.

No, I just think they are going to attempt to ditch the term BB and try to ban / register tool removable magazines by claiming this is a completely new type of magazine release.

Read ifilef's opinion and arguments. He's isnt wrong. He just has no legal ground to stand on and that is where he was wrong.

          Fixed Magazine.
          Tool-Detachable magazine.
          Detachable magazine.

They want (trying to) create a system like 1- single shot, 2- Semi-auto and 3-full-auto. Where you can register a Semi-auto, but cant turn it into a full-auto. Or you can take your semi-auto and turn it into a single shot and not have to register.

They are claiming this was the mandate of the law. To create a new class of sacf magazine released AW.

Its 100% clear as day by simply reading the title of the regs. One of the problems I see is that fact they are trying to ban / register a "Q-tip" when there are different types of "cotton swabs". They hate photocopies and are trying to ban a "xerox".

You can thank yourselves for those, if you are an NRA / CRPA member or donor. While we are true believers at M&A, drafting these letters is our job, a job that would not be possible without support for the NRA and CRPA. So, if you like this, please keep up your support for the lawsuit that will almost certainly follow.

Are you asking what are the pros (vs cons) of registering?

If so, the answer is we don't know. If the DOJ regs get published the way they're written right now, then there are almost zero benefits to registering. Honestly, the only "pro" I can think of is that during the next round of AW bans in a couple years, at least if you registered during this round you'd "get" to use bullet buttons (yay! ) as opposed to getting stuck with featureless like those who didn't.

But at this point, this thread is just 3k posts of wild speculation, because the regulations haven't been published yet and the registration form isn't online. So who knows, the registration scheme may end up having more (or less) pros later. Stay tuned.

Most of the regulations in the proposed/submitted forms by the DOJ are illegal for them to do. That could mean most of it gets thrown out, or it could mean that the DOJ and OAL just say "whatever" and publish them anyways, and then we'd be stuck with them, legal or not. The joys of living under a single-party government. Thankfully, as mentioned earlier on this page, an injunction is being filed on our bahalf to stop the regulations from getting published, as well as several additional layers of lawsuits. So, for now, we wait and see. And donate.

And the fact that they're going to make us keep the Bullet Button on our registered assault weapons surprises you? It was very surprising to me that any of you even thought that we would be able to take them off in the first place. This is not news to me.

Everyone on this thread needs to read Michel & Associates letter to the DOJ. It is a meticulous summation of all the arguments made here (but done so in a actual legal way with true legal arguments).

Thanks to them for this 26 page masterpiece. If I was the DOJ, I would be soiling my pants at this document right now.

No, the power to add aws was revoked by the legislature, at DOJ's request. That was one of the reasons the OLL thing took off.

So if the DOJ is sued in court for the reg requirements exceeding the letter of the law what happens if no verdict is reached before the deadline?

The law still requires registration before 2018, so if they tie this up in court with no clear registration requirements this could potentially take years to resolve. At that point the registration window will have gone and passed.

Where would we stand then? Could a court order put off the registration deadline pending results of the suit?

17 years ago the same discussion was had.

If you register, you still get to use your AW legally, in public. With restrictions of course, such as locked transport.

If you do not register, your AW sits at home, and you risk a felony if caught with it. But you didn't register, impressing some people on the internet.

That is it. It is odious, an exercise in frustration, a sign of society heading into an urban toilet, etc., but that's what it is, no more, no less.

Start a thread asking which people wish they had registered in 2000, and which regret doing so. Might be intetesting until it gets cluttered.
