43.5% - Relist - no decision made. Why, Workload- some Justice(s) thinking on decision. Statistically speaking, that means Clerks are working, very hard, to find answers, also during Gay Marriage, Immigration, and ACA also on the plate right now.
27.01% Relist - decision made, but paper work pending...somebody like Sotomayer's clerk is writing something leading edge critical theory infused in dissent to majority decision on summary reversal? Odds rise to 51% based on my number crunching, when Kennedy's last spoken words on Gay Marriage coincide with "2A" in the same sentence, 35% in same paragraph.
12.5% Relist - decision made, but further delayed, related to something new, and relevant, requiring a re-write already written to summary reversal explanation, above. For example, triggered by Justice Scalia's long patient head finally exploding due to Easterbrooks "feelings" decision in the Friedmen v Highland. Something along the lines of "CUT THE CR_P".
9%- 28% Random Ju-Ju - Anything can happen, grant plenary review or deny cert due to CA drought. Come on,this is the 9th. Based on pure game theory, when has ANYTHING gone as common-sense dictates in the 9th?
Summary- numbers need not add up due to rounding errors. My proven model says Odds are:
Relist to June, after Peruta orals. Thus, Jackson will set an all new world record for relists for SCOTUS - currently the Streak for Relists is at 8.

My bet is relist as they try to count to 5. My bet is Scalia and Thomas, who are absolutistswill absolutely not take something if they're not CERTAIN before the hearing they can count to 5. Hence SCOTUS being political. As to when that happens... excellent question, and a great theory of yours! New prediction!
I'm going to see what the court grants/denies before I guess about the next step.
We should get other guesses in here too! Hence my bumping to the top. Even if it is just kc coming around to dump his Eeyore philosophy/hypothesis on us once againsigpicComment
