    Why wouldn't FOPA apply? The mags are legal at point of origin (Nevada) and point of destination (Oregon), so as long as you are transitting California without stopping, what's the problem?

      FOPA may very well apply.

      The problem is FOPA is an affirmative defense. That means that it can only be invoked as a defense during the trial.

      So, you get arrested, you go to jail, you get finger printed, you get your property confiscated, you wait over the weekend to see a judge so he can set bail, you call a bail bondsman, you pay him his non-reimbursable fee to get out of jail, you drive back to your home state.

      You then have to hire a lawyer, drive back down to CA, go through several preliminary hearings, get delayed, get rescheduled, drive back and forth to your home state, miss work, finally you end up in court having a trial.

      Now you get to try to use FOPA.

      In the end, the way CA laws are written, you probably won't be getting your property back, and it will be melted into rebar, and you will be out the bail money, the gas money, the hotel money, the lost wages, and the lawyer bill.

          We lost this battle, but the War ain't over.

          2016 is an election year and post Heller, gun rights fell off the radar of,many gun owners.

          With the track record of the Federal Courts of defending gun rights post Heller and the enactment of Draconian Gun Laws in several States, gun rights will be a issue across the board in all the Federal races.

          If the Republicans can maintain party discipline, give us electable candidates, then maybe enough gun owners in other states will vote so that a pro gun Republican wins the presidency in 2016.

          For the survival of our country, Hillary can't win.

                I don't like the initial ruling or the denial, but I honestly don't see the surprise or the violation with Heller.

                SF made sure to exempt the lock requirement if the gun is in your possession / immediate use. They didn't say "always," nor did Heller say that it was unlawful to require a firearm to be locked up when not in use.

                I also don't see this as being an actual enforceable law.
