If he does issue an injunction, what can the 9th do in response?

The process would be something like this:
Miller to benitez: We want an injunction because the law is unconstitutional, and our case is likely to succeed on its merits.
Bonta to benitez: We don't want the injunction because we want to maintain the status quo.
Benitez: Law is enjoined because its unconstitional.
Bonta to 9th: kill the injunction until the case is finalized.
          9th: ok

I suspect Justice Thomas and rest of the the Bruen Six are less than pleased with the 9th's obstinance.
I like this. I like this a lot. Hoping the time frame is very expedient.

That’s what I figured. As long as I have time to reconfigure my rifles then I don’t care. We just need to wait for Bianchi.

Perhaps I'm more sanguine than you but I think Benitez will issue an injunction as soon as the motion comes before him. Then we get to see what the 9th will do and, presumably, eventually SCOTUS. I feel like this could happen fairly quickly because Bonta will be crying in his soy latte and we all know how California gets preferential treatment in circuit court.

He may just be a youtuber, but he also just sued CA today over the Handgun Roster. I'll give him props for being the lead plantiff in that case!

I do wonder why a separate action was filed against the roster.

It's a race to see which pro rights group can get the laws overturned.

                                Sweep the leg.
                                No mercy.
