Am I about to get screwed? (ebay)

I want to knowI just got off the phone with PayPal.
The first lady I spoke with said that they will put the money back into my PayPal account. She said I could then transfer it back to my bank.
Then I had a conversation with someone in the fraud department. I asked a lot of questions and got some interesting info on the dispute process.
Had I recorded the phone call, would it be legal for me to post it and a public forum such as this?

Don't post until you've got your money back.I just got off the phone with PayPal.

Also, in CA, I think both parties have to agree to being recorded. So, only post if that's the case.Comment

The second person I talked to was actually really helpful. It surprised me. It's been a long time since I called PayPal last, but it wasn't a pleasant experience that time. This time it was very informative. Maybe I'll make some cliffnotes of the conversation.

Call them, and keep asking for each person's respective supervisor.
It happened to me before. and eventually you get to someone high up enough that they realize you're not screwing around.
Scammers won't go too far up because they know they're trying to pull a fast one. Since your listing was honest, just keep asking for the supervisor, then the supervisor's supervisor, etc etc.
Most of the people on the phone and their immediate supervisors are working off a script or else can't help you even if they want to because they lack the authority. You need to reach the man who really has the power.NRA member

I've been in the same boat as you with eGay and rip-you-off-pal.
I sold some silver coins to a gentlemen, he then said they were fake, filled dispute, eGay said I must accept a return from buyer, buyer sent coins back, rip-you-off-pal refunded his money ($150) and I received the coins back....
LUCKILY!!
he didnt **** me and actually sent the coins back. I eventually sold the same coins for $200 a month later so all in all it helped me. I still feel your pain though, tryign to get ahold of eGay is a PIA! They have no numbers listed and you have to jump through a bunch of hoops to even get someone to talk to you.
Good luck with the dispute!

eSpray and stealpal will rip you off every chance they get!
I used both services for years for business (not any more!), got ripped off quite often and it was normal for them. They couldn't care less.
Also keep in mind, criminals use both services intensively for the sole purpose of ripping off businesses and sellers! They make a good living doing it. They know how their "consumer protection" rules work and they know how to use that to rip people off.
All the rules and guidelines that are in place to supposedly "protect the buyer" make it soooo easy to steal and rip off the sellers.....it makes me want to throw up.
Best bets are:
complete desc and "sold as is"
signature confirmation shipping only
avoid paypal at all costs
confirmed shipping address only
all sales final
cross fingers
Always make a counter complaint(inquiry) and call them directly.Last edited by Got Stuff?; 01-24-2011, 10:34 AM....Robert...

i would still go and fight his claim. I mean don't just give in cause at that point you lose. . Explain what you did. he can't prove the parts weren't there either you can say how do they know he simply did not lie. i would absolutely call him a liar if he is one.
next time write down exactly what the package will include/what you are bidding on and take a picture of what is in the package. Make a itemized list if you have to.
good luck but I personally would fight the guys BS charges.
I had a friend sell a mossberg stock on ebay. the guy who bought it was a complete idiot and broke the adapter/insert when he installed it. Then the punk azz crazy glued it back and claimed we sold it to him broken. never mind we stated used item no warranty etc.he told my buddy he wanted not only his money refunded but also the shipping charges. I only gave in cause my buddy did not wanna get a neg rep on his account but if it was my account I would of told him to pound sand.
yet another reason not to get a ebay account. Douches like these guys make it so its not worth it to me to deal with whiny little punk b*****sComment

For anyone wondering, this is the information I gathered from the PayPal rep. He seemed like an honest, helpful person, but this is just the advice he gave me.
Again, my situation is that the buyer of my broken phone said that parts were missing/damaged. Of course, he is flat out lying, and right now it is my word vs his - all else equal, he has a good chance of winning the dispute.
1. Since I listed the phone as "broken", I COULD argue that even if the parts were missing, it still does not effect the usability of the item. In other words, it's still a non-functioning phone either way, missing parts or not. In this case, the dispute could swing in the seller's favor unless it is specifically spelled out in the item description which parts are included. Just saying "broken phone" likely wouldn't be specific enough.
Even if there are pictures of all the parts that still doesn't imply that those parts are included. The buyer would have to be specific about each part included. This is my problem, as I specifically stated that all parts of the phone were included with the exception of a few parts I listed.
2. If I loose the dispute, the buyer still has to send the item back in order to get the refund. But here's the thing: if the item comes back with more damage/missing parts than what he is complaining about, then he isn't holding up his side of the deal.
For example, if the buyer is complaining that part X is missing and wants a refund, he has to send the item back to the seller. If the item comes back and part X is indeed missing even though the seller knows he shipped it, it doesn't matter, he still gets his refund. However, if he sends it back and part Y is missing as well (or is damaged, scratched, etc), then PayPal may side with the seller. In other words, the item needs to be in somehow worse condition than what the buyer is complaining about. This could happen to me, it wouldn't surprise me if he sent me back some old scratched up parts from his junk drawer and kept the like-new parts I sent him for his refurb business.
3. If there is evidence that the buyer has attempted this sort of scam before, the case very likely will NOT end in his favor.
It wouldn't surprise me if it turns out that the buyer has tried this before. I get the feeling his has been through this process multiple times before and is positioning himself to scam me. His first contact with me also seemed to be purposefully "scary", threatening my flawless feedback and all, I'm guessing he expected me to just immediately roll over and provide his refund.

I sold a PDA dell axim 51v case, it was a magnesium? metal case thin and light for 20$ 3$ ship years ago
guy said he never got it. He didnt ask for tracking so first class mail it went like it said.
I already got my money out of the account and Paypal tried to back charge that paypal account. that account ended up getting locked. Luckily it wasnt on ebay, just a listing on a axim site.
Back then it didnt protect sellers and i dont try to use paypal anymore, if i do its with another account.

If you already used the funds or transferred them beforehand, just call your bank and apply a block on paypal debiting your account. That's what I did when a dude tried to shaft me after buying a full Makita set claiming tools were missing. They will side with the buyer no matter how big of a scumbag liar they are.Originally posted by Neil McCauleyAre you actually suppost to "taste" wood?

Wrong. My scamming/lying buyer shipped the item back via UPS. I was out of town on vacation at the time and there was never a delivery confirmation, it was returned to the sender. Paypal still tried to jack my money out of my checking account. I disputed the charge with my credit union and got the money back, but the buyer also got a refund and paypal claims I now owe them the amount. I'll take the ding on my credit report and paypal can get bent.Originally posted by freakshow10mmIf you are mad as hell and aren't going to take it anymore, grab your rifle and head outside.
