I bought a phone for my dad a couple weeks ago. It was sold as it but in the description stated phone did work. I got the phone and nope, phone did not work. I'm still waiting for my money since I sent the phone back

I sold my motorcycle jacket on ebay, and the guy claimed that is was no in new condition, stole my liner, and returned it. They did nothing even though I blew a rod, emailed and called everyone involved. They dicked me out of 140 bucks in shipping costs, and also a liner that is 50 bucks... They guy proly just wanted your good part, and now he will get it for free... F Ebay, never again.

I've been buying and selling on Fleabay for years. I started using PP back when they first became available and like many users, I have gotten the short end of the stick both ways.

Here's what I can tell you about paypal.

IF the buyer wishes to return the item, the seller MUST allow them to. Even if you list the item as broken for parts only, etc, etc...

However, the "Trick" to this is the buyer MUST provide paypal with verification that the original seller received said item.

Scenario goes a little like this.

Seller sends product to buyer.
Buyer does not like product files a dispute with paypal.
Paypal mediates dispute.
Seller agrees to refund money, less shipping charges IF the buyer will ship the item back.
Buyer agrees to ship item back
Seller "NEVER RECEIVES" item from buyer
Paypal sides with SELLER as buyer did not fulfill their end of the agreement.
Seller keeps money
Buyer who tries to scam seller gets nothing.

Unknown item in undescribed box goes into recycle bin never to be seen again...

ddn't go see your auction, but I know (from friends) that if you've put "broken"/"not functional" in your item title, then paypal will side w/ you. If this is the case, just give them a call and you'll get your money back.

That's why I refuse to ever do business with ebay/paypal again. They ALWAYS side with the buyer. They screwed me out of $250 and then banned me because I wouldn't reimburse them for the money that they refunded the buyer.

I sold a broken Intel Core i7 processor which I clearly listed as "broken". The buyer then filed a claim that I sold him a broken processor which is exactly what I listed the auction as. Idiot buyer probably didn't even bother reading the description and bought it thinking it was functional. Of course after numerous phone calls and emails, Paypal sided with the buyer. Seriously WTF?!

The key is: did you put it in the auction title? If so, then you should have gotten your money back. I know some paypal/ebay workers and this topic came up a while ago during some conversation.

I made a living from ebay and my flea market for almost 10 years and after the economy along with ebay and paypal fees and their monopoly and the need for health insurance i started working a stable full time job, I still do casual ebay sales and still sell every weekend at the flea market.

You listed and described it correctly showing the phone in pieces was a plus

Even with the description it will be hard to convince paypal to side with the seller. In this situation they will probably ask that you offer a full refund for the phone. I would fight it and see what happens , If you lose then offer the full refund once the phone has been shipped back to you and inspected.


Paypal and ebay both are on the side of the buyer and offer very little for the seller. Trust me i know from experience.. I sold 2 suits of armor statues to a guy on ebay , Total was almost $800 including shipping etc , I had these drop shipped due to size and weight. My supplier shipped them via UPS , Sent me the tracking info. I sent the tracking info to the customer . The day after i showed them as delivered the customer filed a paypal claim and tried to get their money back. I scanned and sent them all the info including the delivery signature of the person who signed for it. Well long story short the customer got the statues and also got their money back. I had all the proof it was delivered but paypal did not care..

He is saying that all parts are not included. His claim is that a lot of vital parts are missing (LCD screen, motherboard, etc.). It's an outright lie, I spent a lot of time packing that thing up. I even separated all the main components of the phone and wrapped them individually so I remember wrapping/packing all the parts he is saying aren't in there.

Short answer, yes. I have been selling on eBay for ten years now and it has only got worse and worse. More specifically when eBay acquired paypal things got out of hand in terms of item disputes. eBay/paypal will almost always (99% of the time) side with the buyer. This is because eBay does not want to alienate the buyer, and finds that typically a seller will continue to sell even if they get screwed once or twice. eBay is setup to side in the buyers favor. Notice that as a seller you can NEVER leave bad feedback for any buyer and only go to the resolution center. Typically even if you prove your case paypal will request that you just issue a refund and sell the part again, thus leaving you holding the bag still. It blows man, it has happened tome numerous times but there is little you can do. For this reason alone I do not sell anything of any major value on eBay as it is just one big scam these days.

You are about to lose your money and your product. Had it happen twice now. Basically the guy wanted your phone for parts and didn't want to pay for it. I refuse to sell on ebay any longer I will purchase only because that is the only way you are protected.

If you dispute it, they will close your Account.....I hear about this crap all the time lately.
That place is like the Wild West, full of scammers and folks selling snake oil.

Now I'm really pissed. They just stole the money from my checking account.

An automatic charge from Godaddy went through today, and they just tacked an extra $190 onto the charge. Very sneaky.

I think I will go to my back and see about reversing the charge and filing a police report.

I just got off the phone with my bank. They said to call PayPal and see if they will reverse the charge. If they don't, I downloaded the PDF form I need to file a fraud dispute.

I'll call PayPal, most likely get told to f*** off, file a police report, and drop off the fraud report at the bank.

I just got off the phone with PayPal.

The first lady I spoke with said that they will put the money back into my PayPal account. She said I could then transfer it back to my bank.

Then I had a conversation with someone in the fraud department. I asked a lot of questions and got some interesting info on the dispute process.

Had I recorded the phone call, would it be legal for me to post it and a public forum such as this?
