Assaulted while purchasing custom .45 from Duncan's employee

    Any unwanted touching is a battery. It would be a citizens arrest, and the DA would never file on it. You still could have called the Sheriff's Office though.

    I have not been inside of Duncan's for a long time. Sounds like they have an issue with their employee.

        It's not a case where any DA would file charges... The "Nudger" would only have to say he stumbled into the OP to negate any battery... Or even say the OP assaulted him and he was defending himself....Or it plain just didn't happen.

        Besides after the fact reports made days later for exceedingly minor batteries with no injuries are just a waste of time....They never get filed.

          I'd bet there is another side to this story.

          Adults who have been out in the world for any length of time will have observed behavior which reaches a certain level of rudeness and gratuitous disrespect. Beyond that point, all bets are off. It might be called "Begging for an ***** whipping." Think the employee might have a response to the OP's version of the facts?

          Just looking at the available facts, the employee probably shouldn't have followed the customer into the parking lot, but there are people in the world so incapable of acceptable behavior that sometimes it might seem like exactly the right thing to do.

              I've spent a lot of time in Duncan's. Bought some guns there. Had work done there. I have never EVER, not even once witnessed anything like the OP described & the people I know there would NOT behave as described.

              I wouldn't mind hearing the other side of the story. And no, I'm not in any way affiliated with Duncan's. Just a satisfied customer.

                That is the offending party's decision, not the victim.

                And yes, that is specifically why people with assault or battery, or domestic battery charges are not allowed to own firearms.

                If you are attacking someone unprovoked or without cause, your means to do harm should be mitigated - that is just common sense.

                On the other hand, if you have not done such acts, you should have every right to carry, and defend yourself against just these type of people.

That's about it, he wanted to fight, I wanted him to open his mind to the possibility that he may learn something from the world class engineers that design and build one of the last handmade works of art in USA firearms.
                  Report the *****clown to the owner/manager immediately, he should be immediately fired! Someone with that short a fuse has no business working in an establishment with firearms!!!

                    Perhaps contact the manufacturer and advise them of the behavior of their dealer in handling the custom firearm you waited over two years to receive.

                    You might also ask if rough handling by the dealer will affect any possible warranty issues. The sooner it is documented, the better.
                    Just taking up space in (what is no longer) the second-worst small town in California.
