    Father/son AR transfer

    My son is in the Army and will be going to Hawaii for 5 years (bummer huh ?).

    I have an AR 15 that I want to give to him for Christmas when he is here in CA.

    I have read the is no paperwork for a long gun xfer from father to son. Is that correct ?

    12078 (c) (1) Subdivision (d) of Section 12072 shall not apply to the
    infrequent transfer of a firearm that is not a handgun by gift,
    bequest, intestate succession, or other means by one individual to
    another if both individuals are members of the same immediate family.


    He will take the CA (registered to me) rifle to Hawaii. How does he deal with it there if it registered to me and given to him ?

    Check with Hawaii on ar style rfles and with the base where he will be posted. Hawaii has strict gun laws. Also an oplaw should be done. Formal transfer of firearm.

      I thought OPLAW was only for handguns.

        If he wants the ar possibly grandfathered in he probably should do the paperwork before 12/31/2013 if sb374 goes thru. Lot of people are waiting for oct 13 to see what our options are.

          Assuming SB374 goes through, and assuming the father gives the rifles to his son before 12/31/2013, can't the son just submit the SB374 registration paperwork in his name?

          And won't everyone have longer than the end of this year to register? Why the rush to register before 12/31/2013.

            For hawaii the major ar restriction is 10 round mags. Otherwise when he gets here he will need to register his long guns and get a permit and whatnot. He'll be okay though

              If the issue is ownership prior to 12/31/2013 then he may need to create the paper trail. No one knows right now. It is all up in the air till sb374 goes thru or not.

                It used to be - and I don't believe this has changed - that if he lives on base then he will need to turn any personally owned weapons into the armory for storage. Just an FYI...

                  That rifle has never been registered to you, so no worries there.
                  You are correct, there is no paperwork for a long-gun transfer from father to son. If you gift him that rifle on Christmas (but before 1/1/14), you're both good to go.

                    I think OP should clarify why he thinks this is registered to him. Is it a RAW? Whole different set of rules regarding RAWs. If it's not a RAW then it's probably not registered unless you voluntarily submitted registration paperwork to DOJ.

                        Yeah that's what I was thinking too, but he should clarify. Otherwise, he could be getting some bad advice here.

                          If I remember correctly since he's military he is still a resident of California even thou he technically lives in an other state or country. But I could be wrong as I've never served in the armed services and I thank him for serving.

                            Some posts may still be on a power trip and require even off post soldiers to register and store their weapons in the arms room. Good luck getting them back to shoot when you want to. Thats another can of worms and paperwork to sign them out and you may not even get permission let alone someone to come unlock the cages.
