    marijuana and guns

    I have a friend who has a prescription for marijuana. This friend noticed that when filling out the forms when buying a gun it mentions the illegal use of marijuana, or something to that extent. If he has his card, then would this be breaking the law? Are the forms you are filling out for CA use or Federal use. If its for CA then its no problem right? Of course my friend never uses marijuana and shoots at the same time.

    the 4473 is a federal document. weather is ok or not, I dont know.

      Considering the 4473 is a Federal form and weed is still illegal Federally speaking, I would say your weed smoking buddy better get his stuff together and quit a) shooting or b) smoking weed.

        well as you stated, it asks if illegal use. technically it is not illegal if prescribed(to the state)

              But the feds don't see it as legal, and its a federal form to buy the gun, not a state form.


              ETA but maybe if he checked "NO" for illegal use it could be argued that he's a legal user? Who knows...

                Legal marijuana prescriptions are not recognized federally, only by the state, so the Federal govt. would say he's breaking the law.

                  Your right about the federal thing but unless he gets busted by feds he is legal in cali.Its weird you can get a card to smoke pot but i cant own a handgun if i can not tell it is loaded by looking at it. odd but nothing against legal weed.

                    As far as the Marijuana goes he is protected under Prop. 215. If he answered "No" to the marijuana question he will pass the DROS fine, unless he has been convicted.

                    Reminder Maryjane and guns do not mix well..

                        Yeah, I think its absolutely ridiculous. I remember going to gun shows in Nevada and staying in the hotels inside CA, because of the weed laws, and then driving to Nevada and buying ammo and checking out all the ARs and AKs, knowing I would go to jail for a long *** time if they found weed on me, and knowing I would go to jail if I brought an AR or AK into the PRK. I heard Nevada is loosening up, dont know if its true though.
