All I had on was flip-flops and some swim trunks. I got a half dozen or so scars from it. Getting hit hurt.....about 5 minutes later it REALLY started to burn!

Discharging a firearm is deadly force.
It does not matter if the firearm is discharging less lethal or letal ammo, the same standard to determine if the shooter is justified applies.

Shooting another person with less lethal ammo (rubber/rock salt/beanbag/etc) will result in an assault with a deadly weapon charge (amongst other charges), unless the shooter can prove that they were in fear for their life/great bodily injury when they discharged their firearm.
