EMS is theft.

If cop, maybe thought it's not locked up?? But didn't know procedure? Otherwise, theft as well.

Isn't it ok to have a rifle in plain sight in a business in CA?

I can see why there might be hesitations about sending a video and admitting not having it locked up.

Was there a crime reported to be occurring at the

location?

Who was injured inside your business which required EMS?


How did the police and EMS gain entry into your business?


Was a crime or incident report issued based on what occurred at your business?



Who was present at your business who locked up your business after the police and EMS left the location?

Was you firearm secured as per California law?

Do you realize that Law Enforcement is required to take firearms and hold them for safe keeping when there is no one available to legally take possession of them?

So many un answered questions.

Answer the above questions, and maybe we can have a discussion about the situation.

But why wouldn't your first call when you saw the video to be to the PD to find out what happened?

Get some legal advice. LEOs can be vindictive SOBs. Check if you have any culpability for having a firearm out and unsecured like that. They might spin it one way, and then get you at another angle.

Make a copy of the tape. Do NOT give them the only copy. Then report it. Be prepared to answer why the weapon was not secure in a safe. Especially if no one was there.

I would make a copy and keep it, then tell them you gave them the only copy and see what comes of it.

If the OP was improperly storing a firearm, and it was held by the LEO's after some unknown situation at the OP's business, just how are the LEO's somehow in the wrong?

All of the OP's questions could be solved by a simple call the the station which handled the unknown type of incident at the OP's business?

Obviously there was some serious situation, otherwise the Police and EMS would not have been inside the business after hours...

Every police response to a situation like the OP described is documented on a report or incident number. Getting to the bottom of what happened and why the OP's rifle was seized is as easy as a phone call.

-Closed business, but are people walking and milling all over the office with a long gun out in plain view? Could the cop have simply taken it and stored it for safe keeping, in order to prevent unwanted “hands” from putting their hands on your gun that was carelessly left out in the open???


-Which agency? If they actually “stole” your firearm, why would you be cryptic about telling us and why wouldn’t you “out” them already?

Even if something was wrong. Officer should of left a receipt or citation why they confiscated rifle.
