    1-in-30 not sure what you're asking?

    After day 28 the dealer BP will cancel the DROS and refund the purchaser or start a new waiting period the purchaser's choice.

    they can't have two open at the same time they cancel before starting the new waiting period.

    Technically, on a delay, if it doesn't get approved or denied it will automatically changed to undetermined 720 hours + a few minutes from the start of the DROS. At that point the dealer has a 30 day window to deliver the firearm if they choose to.
    The 28 days is the last day you can pick up your gun with them if you pass the background check failing to do so you have to re-DROS they don't wait the 30 days so your window is from day 11 to day 28.

    Your FFL must not have ever processed a DELAY. here's an example from a recent DELAY >> UNDETERMINED:
    TRANSACTION DATE/TIME: 06/16/2022 04 : 52 : 59 PM
    EARLIEST DELIVERY DATE/TIME: 07/17/2022 10 : 04 : 04 AM

    Now, it should have only been a few minutes after 4:52pm on 7/16, but DOJ does suck. Maybe if I called in on 7/16 @ 5pm and asked they would have flipped it for me.

    Transaction Date/Time was start of original DROS.
    Delay came on 6/23.

    If any private business operated like that it would be considered a scam because that is exactly what it is. You paid for a service in this case the results of your background check. But if you didn't receive any results at all you should not have to pay for it. Any normal business if for some reason can't provide the service you paid for will gladly give your money back.

    It's like if you walked into the DMV and pay forty dollars for a driver license. You expect to receive it in the mail a few days later but instead you get a letter telling you oh sorry we can't send you a driver license because we didn't get around to making it because we were busy with other things but we're keeping all your money anyway. Have a nice day.


    If you are somehow legally allowed to keep your customer's money whether you do anything for them or not then there is zero incentive for you to do anything for them is there? That is called fraud and theft.
    It's not entirely the same thing. In this case CA DOJ is doing the actual labor (supposedly), but they are waiting on results. It's the results they are waiting on that potentially are taking up to 30 days...so rather than wait for that courthouse in Temecula forever, it'll flip to undetermined.

    You paid for a background check.
    CA DOJ ran the background check.

    Keep in mind..you even get a BG check for FREE after 30 days!!! Yes, because on undetermined they actually run a Federal BG Again! The original background check they run is only good for 30 days. So we (FFLs) have to get the new Federal NICS background check reference to document on the 4473.

    What makes you believe they are doing nothing? Other than during Covid where hundreds/thousands were all delayed I have no reason to suspect that the few delays I received over the past 3 months were a random employee just doing nothing.

    That letter is dated june 28th and loses it's act of law 30 days from when you started the DROS which should be on July 21st.
