    Ammo transport-Burden of Proof

    A CA resident travels out of state with ammo in his vehicle. He returns to CA with same ammo in his vehicle.

    Is the burden of proof on the resident that he is not importing said ammo?


    NOTE: the resident is not a prohibited person. The ammo was legally purchased within CA state.

          I get “states rights” and all, but I just don’t understand how certain states can infringe on our constitutional rights however they choose and just 300 miles away
          in Arizona it’s like a whole different country.

            Any ammo brought back should be in ammo boxes loose with a little dust sprinkled in.

            Ammo new in original boxes is a give-away.

              It is almost invariant that prosecution must establish that the accused has committed all the elements of a crime. (A confession is one exception; there might be more.)

              Don't talk yourself into jail.

                  If using mobile phone and not able to use search bar, hit search bar, ADVANCE SEARCH and you should be able to do a search.

                  I would tend to agree that burden of proof would be on the state. Of course make sure there isnt any evidence that could be used against you. For example an out of state receipt for like type of ammo, a possibility some officer conducting undercoverwork saw you purchase ammo over state lines, or you admit to a crime. If any of that evidence exists you should make sure you have proof that you visited a place to shoot while out of the state. It wouldnt be a crime to buy ammo (just like you have on you from california) out of state and use while out of state. But it would raise suspicion and could be used against you.

                  If stopped they will likely question you. But if you say that you bought it in california and they still decide to charge you/confiscate the ammo, they probably already know more than you think they do. Police typically wont put it in writing on something they cant justify to the D.A.

                  What I'm saying is if you legitimately brought ammo from california to another state, then back to california, then no crime was committed and dont let anyone talk you into admitting to something you didnt do.


                  And this is not advice on how to break the law. I do not advocate for that.

                    I left a dozen boxeds of ammo in El Paso at our hunting ranch I took a pic of it here before i left with timestamp and location.

                      aside from the sac state professor who stalks the cabelas in Reno......has anyone ever been pulled over and searched and been detained and convicted of transporting more then 50 rounds of ammo back into the state? If so, how did the officer know? All ag checks usually just waive your through......

                          I also do not advocate breaking the law. I will not provide information of how to skirt any law.

                          My question was more than hypothetical. I was asked by a family member the question I posted here because of their circumstances. I truly did not know the answer. I appreciate this learning opportunity. Thanks, guys.

                              No one has been popped for importing ammo that I'm aware of, and I'm in and out of the SF bay area 4-5 times a year. I've been asked about potatoes I leave them in Idaho. NO ONE has ever mentioned ammunition.
