        Some of us were discussing the acquisition of large capacity magazines while enforcement of Penal Code 20310 enjoined and specifically the fact that so many members of internet forums post their purchases and receipt of LCMs. The kindest thing a retired LEO could say about that is some people are just dumb.         Sheesh! I get the exuberance in what appears to be a opportunity to legally get some LCMs, but as Chuck Michel pointed out in the recent pod cast their acquisition isn't risk free, even though some opine that should 20210 be deemed constitutional that enforcing it against those acquiring LCMs during the stay would be a violation of due process and/or an ex post facto law. Perhaps and perhaps not.

        Kiltlad. I didn't mean to pick on you and am not calling you dumb. Smart people sometimes do dumb things.

          The main issue is this. The civil law system is horribly broken and no one actually knows what any law is until a judge decides what the law is. This is called Kritarchy and it is a form of anarcho tyranny. This is an age old issue and the theories on it have spanned thousands of years. The founders were incredibly lazy when it came to decide basic laws and they simply copied the then current common law books as a basis. Unfortunately, this superimposed stare decisis and shoehorned a common law tradition onto a civil law basis.

          As such, there is no actual law of the land until a judge decides what the laws actually are and even then... who actually knows? Judges can flat out ignore blackletter law if their clerks can shoehorn in some exception to it.

          Most are horribly ignorant to this root issue and are only aware that there is just something "wrong". But this has been a well known and discussed issue since... well... the anti-federalist papers warned of this very problem being inevitable.
