    FFL's that overcharge transfer fees

    Last year I sold a colt .45 to a fellow calgunner, the PPT was done at
    Battlefield Adventures in Ventura. After we completed the paperwork and I received the funds from the buyer, the owner of the shop asked the buyer to pay a $65.00 DROS fee. I interjected and informed him he could not charge more than $35.00, per state law. He explained that his overhead had gone up and he could charge this exorbitant amount. I didn't want to argue or debate the issue, the buyer paid the fees and we left.
    What recourse do we have to prevent this fee gouging? Does reporting him to the DOJ really get results?

    I don't know the specifics of your transfer. This happened to me because other party was not a CA resident, but the transfer could still be completed because the gun was on-roster. That day I learned that PPT didn't just mean face-to-face, but rather "between two California residents."

      If I were you I would call the DOJ on them. We (buyers and sellers) have to follow the law, the FFL should as well.

        For as many of these threads as I have seen, and as many times as someone has complained to the DOJ, I have never even once heard of the DOJ following up, admonishing or even correcting this breach of law. Anybody heard differently? What do we have to do, sue the LGS for $30 in civil court?

          call the DOJ right in front of the store, but after you get a document stating the store's illegal charge.

          then walk about and goto another FFL.

          these FFL's that charge illegal prices know they can do it because the people won't report them and/or they will still pay anyways.

            Well I have called the DOJ on an FFL, gun world in burbank, when they refused to give me a copy of the DROS. The gentleman at the DOJ tried to call them while I was on hold but no one answered. He took down my info, the store's info and who was the person I dealt with. Less than an hour later I got a call from the store's owner apologizing and asking me where he can send a copy of the DROS.

              Cobra Tactical in Santa Clarita charges $45 for a PPT, they tack on a $10 "handling fee." I have the printed recipt I can post from November. When I pointed out they are only allowed to charge $35, including having them pull up the DOJ's website stating that, they informed me they talked with their DOJ rep and he said it if ok to charge a handling fee on PPT, so take it or leave it.

                  I just purchased 3 long guns from 2 seller and did the transfer at Knights Tactical in Camarillo. I had the sellers meet at the same time hoping to pay one DROS I was told I had to do 2 because of the 2 different seller. At the end I was charged $105. I said "I thought I could buy 2 guns from the same person on one DROS", the owner responded "it's a lot of paper work".

                    Looks like Knights Tactical in Camarillo is in violation of the law. It's time we start reporting them for over charging us.

                    Penal Code 28055.

                    (a) For a sale, loan, or transfer conducted pursuant to this chapter, the purchaser or transferee or person being loaned the firearm may be required by the dealer to pay a fee not to exceed ten dollars ($10) per firearm.

                    (b) No other fee may be charged by the dealer for a sale, loan, or transfer of a firearm conducted pursuant to this chapter, except for the applicable fees that may be charged pursuant to Sections 23690 and 28300 and Article 3 (commencing with Section 28200) of Chapter 6 and forwarded to the Department of Justice, and the fees set forth in Section 31650.

                    (c) The dealer may not charge any additional fees.

                    (d) Nothing in these provisions shall prevent a dealer from charging a smaller fee.

                      He can sue the ffl if it was ftf ppt 35 bucks plus lock is all they can charge, When I see rhem at Ventura gun show I will pin them on it. Do not like them anyway.

                        Glock store tried to add on a $50 tax on a ppt. This as after they spent two hours trying to fin my gun and paperwork. I pushed back calling them out on their tax and they wouldn’t budge. Finally a manager stepped in and waived it.

                        Never been back and never plan to.

                          Just for kicks,

                          Take them to small claims court. Fill out the papers and serve the bastard to show up in court.

                          A couple of these and they will get their act straightened out.

                            Ask for the "DOJ rep" name so you can call and verify.

                              Having never bought a gun while I was in California, how much paperwork can there be? Even if it took a full hour to do, 35 bucks seems like more than enough.
