CA Ammo Ban - Explained

You know I use to think that way too.
One night leaving the sand dunes around midnight me and another guy both pulling sand rails on an open trailer were pulled over as we were entering the freeway by homeland security (customs).
There were 12 of us in a group and we were the last 2 cleaning up and heading out.
I was following the other truck and trailer, One customs truck pulled right in front of me between the two of us as I was entering the freeway cutting me off as he pulled behind my friend.
I went around the customs vehicle as I was merging onto the freeway and the second guy lit me up.
Said I had a tail light out on the trailer.
I looked back at the trailer, both lights are working and I told the customs guy LOOK AGAIN.
He said well ah, what are you doing out here this late?
I said WE saw you guys sitting over there for the last 3 hours watching us, you should have come over and chatted with us as long as Your fishing for DUI's.
At that point I was free to go.
Probable cause is anything a bored officer wants to dream up.
What are the regulations on transporting ammo that you already own?Last edited by RTE; 12-31-2017, 9:03 PM.Comment

I can understand that. Me driving back from Vegas in the middle of the afternoon, highly doubt I will get pulled over and asked if I'm bringing back ammoYou know I use to think that way too.

This is me being ignorant to the law, I know, but what is honestly defined as probable cause?
I've been pulled over one time in my life. New Years day, five years ago short just about six hours from now.
I was headed home form my girlfriends' at the time, about 4:30 AM. I was pulled over by a sheriff. The reason? I was driving too well. Literally, actually, genuinely, seriously, truthfully, really, this was the reason she gave me when she walked up to the window. I was driving too well, and she wanted to make sure I wasn't over-compensating for being drunk. I'm somebody that, stupid as you may think it is, uses my turn signal when leaving my driveway because it's habit.
it didn't throw me into a tizzy. In fact, I was largely OK with it, partially because she was incredibly friendly about it, but largely because I felt she was genuinely putting an effort forth to save a life and catch a drunk driver. Was it overstepping her bounds? I don't know. Was there probable cause that gave her reason to pull me over? She gave me a probable reason that she did it.
Beyond that point, what defines probable cause to search a vehicle? Is it subjective, something that, if taken to court, is judged based upon a case-case basis, or is there a defined criteria for it?Comment

When Dr. Wintemute's minions run their operations, they will provide the CHP with probable cause. They work in teams. The parking lot group will take pictures of the CA plated vehicles and the people getting out of those cars. The pictures are sent to the people working inside the store or gun show.
Then two or three people will tag team to follow the people inside. They use hidden cameras in buttons, glasses, or other pieces of jewelry. They record the person buying CA illegal items.
This information is sent to the CHP stationed at the CA agriculture inspection station. Dr. Wintemute provided the CHP with a plate reader to be used at the Ag check station on I-80 a few years back. The license is inputed and when the vehicle returns it alerts the CHP at the Truck Inspection station. An Officer then meets the driver at the Ag. inspection station or pulls the driver over. The picture of the purchases are the probable cause for the stop and search.
I have attended a couple of Dr. Wintemute's talks on his operations. He is not stupid, he knows his operations will not come close to catching the majority of people who violate CA laws. They do catch some and that has value to send a message that will stop others from trying. Their fishing expeditions also net people violating other laws like transporting loaded guns or transporting handguns that are not in locked cases which Dr. Wintemute claims reduces the potential for gun violence. In reality, it just self-validates his junk science.
The smart move is to stay away from Cabelas in Reno as that is one of their favorite places due to it being so isolated. The only people that pull into that parking lot are there to go into Cabelas. They stay away from Scheels because it is in a huge shopping mall which makes it nearly impossible to track people from the parking lot into the store. It is hard to determine which store people are there to visit and often they visit more than one. Wintemute's group want to get the most violators with the least amount of effort.
We all know this law is nearly impossible to enforce. A few will be caught. The easiest way to avoid detection is to drive around the Ag. inspection stations, this is not hard to do. I have not driven through one in over 10 years.
Ultimately, enforcement will target the low hanging fruit. Then again, there are many ways to legally buy out of state and return with your ammo. Read the law and find the legal way that fits your situation and use it.Anyone can look around and see the damage to the state and country inflicted by bad politicians.
A vote is clearly much more dangerous than a gun.
Why advocate restrictions on one right (voting) without comparable restrictions on another (self defense) (or, why not say 'Be a U.S. citizen' as the requirement for CCW)?

Rocklin?Got curious. Ran down to Sportsman's Warehouse. All ammo is in locked cases. Asked their department manager if they will be selling ammo tomorrow. He said absolutely, just has to be locked up now. Here is a photo of the cases and a new sign.

Like I said previously, no one will care because it is an infraction. This has never deterred anyone from speeding and it won't stop them from buying ammo and bringing it in. That being said, I agree that there are many useful exemptions to the law.The American Republic will endure until the day Congress discovers that it can bribe the public with the public's money.Comment

I had not considered that. It would also be a lot of effort just for an infraction.
I think it will be like the other efforts, something done occasionally to provide data for the anti-gun doctor in another hit piece he wants to write or to serve as a PR piece he can use to raise more money for his cause.
Ultimately it will be the idiots that get caught in his net.Anyone can look around and see the damage to the state and country inflicted by bad politicians.

Getting pulled over for “probable cause” is just a matter of common sense, isn’t it? I was pulled over years ago in my old, beat up work van. I was coming back home after taking care of a late night emergency maintenance call at the retail center property that I maintain. I left home in such a hurry that I forgot my wallet and stupidly, I also had my registration in it. So, when the LEO asked permission to search my vehicle I consented because I knew that without my paperwork they could, at the very least, tow and impound my vehicle. I had nothing to hide so common sense said, bite my tongue and let them do their thing. Different circumstances, different reactions and outcomes.Comment

My brother was a cop and he took me along with him one night for a couple of hours so I could see what a patrolman does. What I came away with (other LEOs can confirm or refute) is the impression that most officers develop a sixth sense for which vehicles to pull over or when they need to investigate further. Most of them don't pull people over just because they can. Of course there are a-holes in police departments and there are some departments that abuse their office but generally speaking you have nothing to worry about if you're not doing anything wrong.
Getting tagged for an infraction is nothing compared with getting tangled up in a civil asset forfeiture action.Comment
