          If you fail the background check it's not the sellers fault. If you don't agree to the terms don't agree to purchase the gun. Very simple...

            Remember the seller going and getting the gun back is optional for him. He can easily just walk away and the FFL then surrenders the gun to LE for destruction.

              I dont get it. If it does not go through, the gun is confiscated and destroyed?

                If it does not go through AND if the seller does not retrieve it, then yes, the FFL is required to surrender it to LE.

                As stated above, the buyer does have the option of negotiating something with the FFL to arrange for another buyer or transfer to a person in another state.
