    You are truly in denial aren't you? When the author of the video admits that it's a negligent discharge and doesn't even want to post it for the public. Call it what you want, but the truth was negligence.

      But in this case, it was his prep and planning that was negligent.Not the handling of his weapon from what I saw on the video. Or are people saying it's an ND everytime someone forgets their ears for the first shot at the range? Or not wearing any at all while hunting?
      According to Jay M. Feinman of the Rutgers University School of Law;

      The core idea of negligence is that people should exercise reasonable care when they act by taking account of the potential harm that they might foreseeably cause to other people.
      So you say it was negligent because of his prep and planning. That's the point! He was negligent for having a round chamber while demonstrating his handling of his weapon. Take note for the quote above.

      If your argument was referring to a tort in common law, why didn't you specify that in your early replies?

          Your disagreement doesn't change the definition of Negligence.

            And the definition sides with my main point here. Or, as I asked before, does forgetting to put on your ears before your first shot of the day make that shot an nd?

              No. With the available resources with him: multiple cameras and crew, he was negligent by not checking the chamber immediately before demonstrating his finger manipulating within the trigger guard.
