Depends how "rural" the area is & also the D.A.'s position on guns. You're lucky they didn't immediately confiscate all your guns. I hope you only end up with a fine.

Yup, if you did something stupid and may win the proverbial "stupid prize"....


If the impact area was off your property / out of your control you could be charged with reckless endangerment. If there were other structures within 500 yards of your house you were already in violation of the law. How. Your neighborhood is zoned could be another scource of changes. Were you close to a school? Public road? Your neighbors called it in??

If its an unincorporated town all you need to be is 150 yards Away from houses or roads. I have been rolled on before and haven't had an issue.

It was the riverside sheriffs, I live in cabazon, no schools near me. I do have next door neighbors. No roads or buildings in the direction I was shooting and I was shooting at the mountainside about a mile away from my home.

Can you see a mile in the dark??? How do you know there were no hikers/campers in those mountains??? Do you know how much your load drops in a mile?? Your bullets were not landing anywhere near where you were aiming.

my guess is that they will be pretty pissed about firing on an unknown impact area about a mile away. I wish you luck, hopefully they just back at at you with a stern tone and a warning.

It sounds like the deputies handled it well. There isn't a lot of detail in your posting to draw conclusions from. About the least intrusive action that could be taken in your example is to document the event and refer for a prosecution decision.

The related criminal charge is the big question, and it really relates around the population factors where you were shooting. On the high side, the deputies could document a "Reckless Discharge of Firearm" (Penal Code section 246.3). That charge is a felony, but is also the type of felony that could be prosecuted as a misdemeanor. They may also have documented whatever Riverside County Code provides for unlawful shooting (the difference between the charges being the level of danger presented to persons downrange).

I'd be extremely surprised to see felony charges filed. Misdemeanor charges are possible, and really depend on the D.A.. You also may be invited to appear at a D.A.'s office hearing. At the risk of over-simplifying the process, its the equivalent of getting "chewed out" by the boss. The hearing officer will visit the facts of the incident with you, and if satisfied that no further judicial action is needed to impress the significance of the event upon you, then its over. Make sure that you really understand what the process is before you walk in the door.

It doesn't matter how many miles are there, what if someone was out there? Be safe!

Talk to your neighbors, if they called they might've thought something bad was happening. Who knows, they could be pro gun and just tell you to let them know when you do it again.
