    Anywhere in US without background checks?

    I hear or prez railing against guns but isn't it federal law in the US you have to go through a background check? I hear him mention the 'gun shows' are these really treated differently?

    Are there states you can walk in a buy a handgun the same day?

    If you buy from an FFL in any state (assuming you aren't buying black power or antique), you go through a background check.

    Also, in most states there is no waiting period for long guns or handguns.

      There is a private party sales exception in some states. In Nevada, for instance, if I have a S&W Model 10 and you want to buy it, you give me money and I give you the gun. There is no registration or government interference.

      It is illegal in all 50 states for someone to sell a gun to a person they should reasonably know is "prohibited." If I know, or should reasonably be able to know, you're not old enough, a felon, cray cray, etc. it is against the law for me to sell it to you.

      Pretty much every other state but CA you can walk in and buy and be shooting in the same day. Even if you do a background check, you get the gun right then and there. The 10 day wait doesn't exist for them to do the check, they get the results from NICS in about 5 minutes.

            PPT not facilitated through an FFL, which does bypass the background check process.

              Nope. In many states, no NICS background check is performed by an FFL if the purchaser is a CHL/CCW holder. Photocopy of your DL and CHL plus a 4473 and you're done.

              Agreed - I always ask to see the person's DL and CHL - if photo and info match the person in front of me then we're GTG.

                  You do get a background check when you apply for the CHL. For some reason we could never get that to pass the general assembly here. It could probably pass now, but McTwatwaffle won't sign it.

                    Completely agree and that's why it makes the whole 10 day wait a pointless exercise for someone that the CA DoJ, local Sheriff/CoP and FBI have reviewed to be able to carry a concealed handgun.

                      The whole 10 day wait is pointless for anyone who the governemt knows to already leafs ly own a gun, which was the basis if a recent judicial ruling.

                        The gun show loop hole is just something the anti 2A people use. In other states where a background check for ppt is not necessary they will meet up at a parking lot outside of a gun show and do a ppt but they could do that anywhere else. Inside many gun shows the ffl does the paperwork so it's really the ppt the anti's are going after.

                          In Utah you just browse the local internet listings, call the seller, meet somewhere with cash and do the exchange. The government or a FFL need not be involved.



                          A good percentage of sellers ask for a DL and CCW.

                          We don't have any sort of registration, waiting periods, safety cards, etc..

                              Only 8 states (California, Colorado, Connecticut, Delaware, New York, Oregon, Rhode Island, Washington State) require a background check for all firearm transfers, including between private parties (so-called "universal" background checks). President Obama and gun control groups want the whole country to be like those 8 states.

                              2 more states (Maryland and Pennsylvania) require background checks for all transfers of handguns only.

                              4 states (Hawaii, Illinois, Massachusetts and New Jersey) require firearm purchasers to obtain a license or permit first, and a background check is required to obtain the permit or license. 4 more states (Iowa, Michigan, Nebraska and North Carolina) do the same only for handguns.

                              That leaves 32 states where background checks are not required for private party sales, or gun show sales of firearms by non-dealers.
                              It isn't just "a few" states that don't require background checks for sales by non-dealers, most states don't. Most states are not like California.
