Private Property hunting?

A buddy was asking me about hunting laws yesterday. I'm not a hunter and had no idea.
He owns 40 acres in Southern San Diego. He's been trying to grow Olive trees but the deer keep eating them. Can he legally shoot them without permits, tags, yadda yadda?

NO, He needs to contact fish and game or whatever they are calling themselves these days. There is some type of nuisance provision but he still needs to have a permit if I'm not mistaken. I think it only kicks in after all other options have been exhausted also.

And I don't believe he can let his " buddy" do the shooting either. I think they will have to be named on the permit.

Your buddy can also buy a compound bow and a shovel and just not tell anybody about it, too.

Hahaha. I was thinking along those lines too. Unless the deer is specifically tagged with some kind of identifier, then... yeah... what deer?

I'm sure there are many on this site that would love to help your buddy out during the appropriate season. Just don't injure them with a pellet gun.

The state owns all wildlife, regardless of where it happens to be located within the state. All Fish and Wildlife regulations apply.

In your case, you should be able to easily get a depredation permit. You, or your designated employees/agents can control the wildlife listed in your permit. Don't push your luck with letting everyone and their mother participate in the taking of deer, and you are dead meat if you allow someone to pay you for the privilege. CDFW is very accommodating with depredation permits as long as they are not abused.

I'm also assuming that when you say "olive trees" you are talking about more than a few and something that approaches a moneymaking operation. If it is a few trees planted by the house, CDFW will laugh and tell your friend to build a fence around his few trees.

At least we know who on this site condones poaching and doesn't care about the health of the CA deer population or the accuracy of deer counts. Nor for figuring out the effects of increased predation by mountain lions, beers, and coyotes.

I don't give a crap what DFG says. If some mountain lion or coyote steals my beers. They gonna get shot.

Olive (Olea europaea L.) is considered drought tolerant and trees can survive on shallow soils with little supplemental water beyond winter rainfall.

He can still grow his trees and use more water for fruit production when the drought is over. If deer are eating his trees, they are still far too small for commercial fruit production.
