      There are arguments that suggest that, even without the PG, that you would still need to be in compliance to add capacity.

      Also, there's no CA law we're talking about here regarding capacity. It's all Federal, as the capacity is still below 10 rounds.

      Are ALL tube magazines exempt from the 10rd limit (I believe rimfires are)? I thought "magazine" refers to "any ammunition feeding device."

      I don't think there is a specific capacity limit as long as you comply with 922(r)

        This letter is a known erroneous one. The parts list incomplete/inaccurate for Benellis and even more so for the M4:

        Benelli shotguns all have a "bolt" AND a "bolt carrier". The letter references only the "bolt". Benelli uses the term "bolt" to refer to the complete assembly, but for 922r or other legal purposes, there is a bolt and a separate bolt carrier.

        The letter is also missing a "disconnector" which is present in all Benellis.

        The M4 list would also add (2) "gas pistons".

        If the Benelli has a pistol gripped stock, the "pistol grip" and the "buttstock" are combined into one part, not two as they appear in the letter.

        So....

        Add the following to the above list to get a more complete picture of a 922r compliant Benelli M4:

        Disconnector
        Bolt Carrier
        (2) Gas Pistons

        And the buttstock/pistol grip issue would have to be adjusted as it applied to your specific M4. If your stock does not have a pistol grip, that part comes off the list.
