So... under HK's theory, a rimfire carbine which has the outer appearance of an HK centerfire product is an example of trademark infringment? How long has the MP5 been in existence? How about the various HK centerfire clones? Are they also examples? Why hasn't HK filed against those manufacturers? Strikes me that this is as baseless as Harley's attempt to patent their exhaust sound...

H&K might be in for an expensive lesson about how US courts work.

Actually, the outer appearance of an item is a trademark. HK is on good legal ground with this. I'm betting it ends with a $50 price increase on the GSG and ATI paying royalties to HK.

Regardless how ridiculous the lawsuit is or isn't, I do have to admit that if the GSG-5 didn't look like an MP5, I wouldn't even consider it. In that sense, GSG is without a doubt benefiting from H&K's brand and design. Does that mean H&K deserves some money? Not really sure.
