The fact is that by law they are required to submit the sales tax. Quite simple. I doubt that they are just paying it for you, which means that they are violating the law. As I said, that means it is just that they are clueless or it is an intentional illegal act, neither of which reflects well on them.

Please provide something more than your flapping gums that they have some sort of special arrangement so that they don't have to collect sales tax. You say a lot, but it seems that you can't back it up with any facts.

Also on shipping too... Not taxed. Look at a receipt from amazon or somewhere else. Shipping and handling fees have been post tax.

I had only paid on main items in the past.
In some cases labor fees are taxed. There are examples where labor is taxed and the transfer fee is just one of them and is not unique.

The issue with shipping is that it is not going directly to the customer, which makes the shipping subject to sales tax. If the firearm could be directly sent to you, then it would not be subject to sales tax. If you buy an item in a store, part of the cost is shipping, but you have to pay sales tax on the total cost to you, including the cost of shipping.

You're so disingenuous. I said at the beginning that I wasn't providing more information. I'll ask them about it, and if they're following the rules I'll post up why they can do that.

One FFL I deal with has me write 2 checks one for the DROS the other for the tax. This way he keeps it real simple

Quite the snide comment, but quite false. Disingenuous is what applies to you, not me.

            disingenuous
            [dis-in-jen-yoo-uhs]
            adjective
lacking in frankness, candor, or sincerity; falsely or hypocritically ingenuous; insincere: Her excuse was rather disingenuous.
All of that applies to you. I am being frank, honest, sincere, etc., unlike you. I am trying to educate people so that they don't think that their FFL is cheating them by following the law, whereas you seem to be trying to the opposite. I am not sure if you are just trying to be a troll or just plain stupid, but certainly you are not honest in your words, nor your motives.

You want to post saying that this mythical place does not charge sales tax and has some mythical method for getting away with it, while also claiming that they are not clueless or intentionally violating the law and "we" are supposed to just believe you. The next thing is going to be that you have a bridge or some swamp land to sell.

If they are not following the rules, are you going to post that as well?

Yeah, you just want to post garbage and don't want people to call you on it.

I'm not saying you are being disingenuous about everything, just about your statement about me, after I already said I wasn't saying anything. And yes, if I find out I'll say that they aren't following the rules. But I'll only say who it is if they are following the rules. Whether they are or not, they still don't charge it.

Somebody's got a pretty "special" arrangement or they've got a big bill coming. Can someone arrange a similar arrangement with the Santa Clara county sheriff so I can get a CCW permit?

I am being honest about you as well. You can refuse to say anything, but that only makes you look worse.

There are no magic rules which allow them to not pay sales tax. It is pretty simple.

They might make up some excuse as they don't want to admit that they are violating the law, but that does not make it so. Go look at the CA BOE information regarding firearm transfers. Look at the letter that was posted. Then explain how they can not collect sales tax and not violate the law.

So, you will say who they are if they are follow some magic rule which allows them to not collect sales tax? Forget their name, post what this magic rule is that allows a FFL to not collect sales tax and not violate the law. I am sure EVERYONE would want to know how to do that. I seriously doubt that there is a single FFL who wants to collect the sales tax.

You're caught up on the perception of it? That makes more sense. Just relax. Take a deep breath. I will talk to the guy and find out. Talking about it repeatedly until then will produce nothing.

Nope. I am just saying that you look bad with what you are saying as it just does not make any sense at all. I think it is a bit funny as well, but that is just my sense of humor.

That is funny. I don't need to relax, but that is a common snarky comment from those who have nothing else to say and refuse to admit that they are wrong.

It really does not matter if you talk to the guy or not because the law is what it is. Now, if there is some sort of magic rule that allows a FFL to not collect sales tax, that would be something to find out about, but most likely you need to get the rule delivered by unicorn for it to apply.

Artema - if your FFL has exploited an ingenious loophole in what appears to be a black and white interpretation to the sales tax requirement, maybe you can share this so all of us might benefit?
