    You did not answer my questions. What more does one need to be aware of other than the FFL is not following the law by collecting the money? Are they trying to be a test case? If so, then it seems that they would want to be known that they are doing it.

        Actually, it is because what you are saying does not make any sense. You want to claim that you know something which makes a difference, but it doesn't.

        So tell me what a CA FFL is supposed to do in terms of collecting sales tax for a penny auction firearm. You said that you were aware of that, so you know what should be done, correct?

          What you're saying is generally true, but you're claiming it applies to 100% of situations. It just doesn't seem to be the case.

                Did you know its legal to aquire a firearm as a gift from out of state as long as its dros'ed here. Just have a packing slip sent with the firearm, and the invoice sent to your house.

                    You can violate the tax laws, make a sale here and there to one of your buddies, or hide a few cash transactions now and then and get away with it - but if you are regularly violating the tax laws, by not collecting sales tax - especially when you have received a notice as a specific type of business, doing transactions that are going to be scrutinized because the state wants to make sure that you are following the laws that provide the state with revenue - when the state is looking to get all the revenue it can - you WILL get caught.

                    I recommend that as a learning excercise you keep exceeding the speed limit as often as possible, and lets see how long it takes before you get caught.

                      The BOE document didn't assert sales tax must be collected 100% of the time - there was an exemption listed. However it seems to me the every day transfers being referenced here don't merit that exemption. If you know otherwise it doesn't seem difficult to post a theoretical example that avoids "naming names".

                          I never said it was 100%. I mentioned C&R firearms from a private seller to a CA resident who has a C&R FFL. So that makes your statement false.

                          Now that is really funny. I would like to know how ANY business in CA would have "special" arrangements so that they are exempt from collecting sales tax. That is quite a claim, but of course you refuse to back anything up, which makes it much more likely you don't know what you are talking about and instead just spewing lies. Clearly, you don't want to admit that you are wrong.

                              I've transferred, from out of state, several guns. Not one did I pay any tax, and they've been in business for many decades.

                                I know they are collecting tax, however in that letter they stated that the handling fee would be taxed and unless something has changed labor is not supposed to be taxed. Handling=labor
                                Also on shipping too... Not taxed. Look at a receipt from amazon or somewhere else. Shipping and handling fees have been post tax.

                                I had only paid on main items in the past.
