    FFL - Interfamilial transfer

    Hello to all

    Mother has a firearm she wants to gift to me for passing a licensure exam and would like to transfer it to me via FFL to FFL, but the FFL in florida says he cannot even ship to this commi state due to it not being on the DOJ roster list. Is this true? Can my mom just ship it to an FFL here through a common carrier(ups/fedex) overnight, abiding by the 10 round capacity regulations via the state. Hopefully i can get some insight from an FFL/Seasoned veteran on the issue.

    Congratulations on passing your exam.

    The roster does not apply to parent / child intrafamilial transfers.
    The magazine, threaded handgun barrels and other "assault weapon" restrictions do apply.

      Intrafamilial transfer is exempt from the CA roster, and exempt from CA sales tax. It must ship to FFL here and be DROSed + 10 day wait. You will need FSC . It can't have any mags over 10 rd unless the receiving FFL has a Hi-cap permit, and they will need to block the mag before they transfer it to you. All AW regulation apply (no threaded barrels on pistols, etc.)

        My parents are gifting me a pistol as well right now and they were having the same issue. In Michigan no store based FFL would ship the firearm.

        Depending on if the FFL you choose here requires it to come from another FFL, try and home based FFL in Florida. They might be willing to work with you on this. Join some regional forums and start asking for an FFL that will ship to California.

        Another option is if your FFL here in California allows shipments directly from your parents. If they do that, you can ship it directly to your FFL with shipmygun.com, which is what my parents did. Mine arrived yesterday morning and I am going to start the paperwork next week when I pick up a lower receiver that I have been waiting on as well.

        By the way, what pistol is being gifted to you?

            BOF Form 4544A is the form to use to report it. Nothing in there states that the family must be in CA. There are limitations on WHO can gift you, but biological parents fit in that description. You still have to have the FSC unless you have one of the exemptions.



            Of course, shipping via an FFL is one way for you to acquire it, but you'll have to endure the 10-day wait that way.

            If you're going to go visit, you might check into the legality of picking it up and bringing it back. If it appears legal (I think it might, but not sure - check with a firearms attorney), I'd recommend you have the 4544A packed with it to show your plan to follow the law on notification. You'll also have to make sure that there are no magazines above 10 rounds with it.

                  OPLAW works only among CA residents.

                    You don't need a FFL to ship the firearm. It just needs to shipped to an FFL. You parent can go to FedEx and ship it to your FFL, I have sent firearms to an out of state FFL several times using FedEx. Just talk to the receiving FFL and find out what documentation they need with the gun (typically a copy of the senders ID and a letter stating they are gifting the gun to you).

                    Have it sent to:

                    Your Name
                    C/O: xxx Gun Store
                    12345 Main Street
                    Some City, CA 12345

                    Once it arrives you pay the fees to the FFL and DROS it like any other gun.

                      Federal laws requires the firearm be transferred through a CA FFL dealer.
                      ^Federal laws prohibits the transfer of firearms between residents of different States unless a FFL is utilized. Since the OP is a CA resident, a CA FFL dealer must be utilized. Failure to comply with the Federal laws equates to a Federal felony for everyone involved with the transfer. And submission of just a CA DOJ BOF form complies with CA laws, but documents the violations of Federal laws making it easier to prosecute for the Feds.

                      There are no laws/regulations mandating the firearm be shipped by a FFL, only that it is received by a FFL.

                      So, you just need to find a CA FFL dealer that knows about and is willing to do out-of-state intra-familial gift transfers and have your parent (the gifter) ship the firearm directly to that CA FFL dealer.

                      Not many CA FFL dealers know how to process this type of transfer.

                      So, if you post your location (city), someone can point out a CA FFL dealer that is nearby that knows how to do these types of transfers.

                        Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

                          I did this with a lever gun back in the day. My father in CT had my Marlin 1894S and when I visited I boxed it up and shipped it here with all the required documents. He acted like it was drugs till my FFL called him and put him at ease. It needs to be received by an FFL here, not sent by one. Look at the link and have your mom call your FFL for instructions. Easy money...

                            thank you very much for the info! i live in the Chino area right next to prado shooting range. If you all can pint me to an FFL that can help me out through this process that would be great thanks again!

                              I used a private FFL in Rancho Cucamonga to do a couple xfers but that guy no longer around. However, he recommended Aces Jewelry and Loan in Covina for future needs.

                              I went by there one day to check it out and spoke to them about doing Intrafamilier xfers and they know their stuff. I've not used them yet but will if need ever rises again.
