As for the ticket, easy to get out of via written declaration. All you have to say is that "Due to safety reasons with multiple Semi-Truck congestionsat a merge lane you felt it was unsafe to be in the lane, moved over to the next lane until passing the congesting or allowing the other vehicles to move in before moving back."

First time I was polite and stated that on 101 in San Jose it is much more dangerous for me to be in the far right lanes because of constant merging, and that I often move over. He let me go. I won the written declaration on both and never even went to see a judge. Sent back my bail money and everything.
