    Actually, contacting them has been really easy. I sent them an e-mail late last Sunday night - I got a response by 9 AM Monday.

      Just took a call from sd sheriff. They were inquiring about an out of state ticket from like 18 years ago. The officer said he was going to call back or email something to that I should add to my application, possibly?

      Weird, but here we are day 77-ish into background check and they're just now working on it. Hope it doesn't delay things too bad, but it kinda sounded like their pushing it through.

          This seems a bit like an issue that came up in the L.A. forum where the Sheriff's office seemed upset with an applicant because he did not disclose a traffic ticket that was considerably older than the 5 year limit the application requires. They seemed to be under the impression that the ticket somehow constituted an arrest even though he was just given a ticket and allowed on his way, and not restrained or towed. Can you share more about the nature of their concern over an 18 year old ticket?
          I wish today's liberals could understand: You cannot be generous by giving away other peoples' money and you cannot demonstrate your virtue by your willingness to give up other peoples' rights.

            When I had my interview they only asked about tickets in the last five years. Strange that they’d ask about an 18 year old ticket.

              As a random datapoint as to why I don't think the 18 year old ticket is an issue.

              I ran out of space listing my tickets in permitium. In part because I'm a menace to society and get pulled over a lot, but also because I was listing dates, citation numbers and disposition (dismissed, not guilty). All of my tickets are dismissed or Not guilty. Also, permitium seems to allow for less space than what the actual box can accommodate on the generated form.

              I put a note in that box that said, "Need more space" so my listing of tickets within 5 years was incomplete.

              They didn't even request that I append an additional sheet.

                It was from may 2003 and iirc, it was a traffic citation (i think driving on a suspended license) that resulted in a failure to appear. the sheriff just sent me an amended couple pages that updates the "traffic violations and accidents in the last 5 years" and "any arrests or criminal charges with or without disposition" to show this 2003 incident as an obstruction of justice charge.

                i'm not even sure that i could verify that was the final disposition of the case, i remember a couple years ago finding the paperwork in my storage and tossing it, it was something like a $700 fine i paid over it when i finally squared up (i think about 5 years after the incident), in payments no less.

                this does seem bizarre, since they're amending my application, maybe to justify denying the app?

                oh well, all that's required of me is a signature. the email says return no later than tomorrow morning. will keep posted!

                  I was about to click send and I remembered that when I had my appointment, we had amended one of the pages to reflect that I had paid, the only other traffic citation on my application. The sheriff wants to add the 2003 case as 5015 / 5405 obstruction of justice.

                  I looked through the March 2021 NCIC codes manual, it lists 5015 specifically as failure to appear, and there is no 5405 offense.

                  I'm thinking I should challenge this discrepancy a bit. Am I overthinking?

                    I think you should at least get an explanation/clarification. I'm confused though, were you actually charged with obstruction of justice at some point, and if so, were you ever notified of this? From the way you tell the story, it almost seems like the deputy wants to decide now it was obstruction of justice and that seems inappropriate. If you were never actually charged with obstruction, or even failure to appear for that matter, it seems to me that listing it as such on your application is simply inaccurate and perhaps even a violation of your swearing that everything on the application is correct. However, IANAL.

                        Ok, so the deputy called me back about my email about an hour ago. He explained that he wrote it just as it showed up in the system, as was his obligation, and he couldn't show me. He said they had to put everything on the application but it didn't mean I wouldn't get permitted. He said I could write in the explanation on the application if I wished.

                        It seemed like a productive call, and the deputy did seem as polite and helpful as everyone else at the sheriffs office I've interacted with throughout the process.

                        From the time of sending the email to receiving the call was barely 90 minutes.

                          Sounds like you could be ok then. If you can remember what was going on back then you can put it in the explanation. We're all human. Sometimes those things get lost in the shuffle, and you did remember paying. Not like the kept coming after you for it either.

                            Odd that you can't see your own record. Just explain as best you can. It may just be a clerical error of some kind. I once bailed a friend who was a 6'2" red haired Irishman out of jail when he was arrested on a warrant for failure to appear for a traffic ticket that the record showed he got back when he was a 5'8" Black man.

                            In any case you should try to get to the bottom of this and get it corrected.
