Any update to this? At the rate we are selling guns this could be a huge problem if we continue to DROS from 12/22 to 12/31. I'm all for doing it, the more SSE guns in folks hands the better, but we don't want to break the new law.www.spencersfirearms.com

I never got a 100% good answer. What I've told my customers is that the ones willing to pickup in 2015 need accept the risk that there's a small chance DOJ will deny the transfer and if they're ok with restocking/not taking delivery in the event it happens I proceed. I did mention based on the feedback I saw here that I thought it was unlikely from the verbal responses many stores had received, but I refused to give a guarantee. For all I know it'll be good for everyone except my customers and it'll take a lawsuit for them to release. I don't want to be in that mess! Any customer of mine (only a handful) taking the risk in 2015 knows there is a small risk that they won't be able to get it. I'd rather be 100% up front then hope it'll be ok and it all goes to hell.UG Imports - Fremont, CA FFL - Transfers, New Gun Sales

What is to stop the DOJ from simply turning off "Deliver Gun" on the exempt handguns in DROS on Jan 1?www.spencersfirearms.com

I think you got it right. The customer needs to know that if he/she fails to pick up within 30 days, normally they would be required to re-dros, but in this case they will not be able to. Since the FFL technically won't be able to re-sell it to someone else, there most likely will be no refund.I will be doing them until the last day of the month unless I hear strong evidence otherwise. If a certain handgun falls off the roster on the 1st of the month I can still start the DROS the day before it falls off and then transfer it to the customer when the 10 day hold is up even though it is after the firearm has fallen off. I don't necessarily have supporting documentation so anyone feel free to follow up with actual laws if they exist on the subject but as of now I'm treating it just like any other sale.

The FFL can sell it to any LEO or out of state person where it's legal. If they are doing "no refunds" hopefully that was spelled out at the beginning or if the customer paid with CC they should expect a charge back and the customer will win as they do 99% of the time.I think you got it right. Well perhaps you are right there, but it really isn't fair to the LGS. He may end up with excessive inventory and have cash flow problems if this were to happen on a lot of cases. Hopefully it won't. My LGS hasn't said no refunds, but I was warned the firearm would not be able to be re-drosed if the 30 days was exceeded. The FFL can sell it to any LEO or out of state person where it's legal. All our responses have came from the DES Support crew, not a DOJ compliance officer. Big difference.Just a normal guyComment

If the LGS doesn't plan and runs into excessive inventory and cash flow problems then --- oops --- bad management.Well perhaps you are right there, but it really isn't fair to the LGS. You can't blame the DOJ for bad management and planning on the part of a LGS. If their own lawyers said it's good to go, then they have them to blame.
If they didn't consult an attorney (as I have not) then I have myself to blame..except in my scenario I made sure the customer knew THEY were taking a risk as well to set expectations properly. I've had customers ask "can you guarantee if I DROS now I will be able to pickup in 2015" and I've said "nope...I think it's relatively low risk from what I have seen, but I cannot guarantee"..
Granted I will only get 25% restocking, but at that discount I can flip most on gunbroker over time. My exposure is much less as I've only had 2-3 guys take me up on the offer and I understand the risk I am taking.UG Imports - Fremont, CA FFL - Transfers, New Gun Sales
