SSE ending.. when last day to DROS?

    SSE ending.. when last day to DROS?

    So, since SSE is ending, when is the last day to DROS a SSE? As long as it happens prior to 12/31? Or does it have to be picked up before 1/1/15?

    I would assume it would be just like a roster gun, that it has to be DROS before it fell off, but was still deliverable after (barring any unusual situation).

    What is everyone's thoughts?

    We will stop DROSing pistols on 12/21/14 and are telling customers SSE guns must be picked up by close of bis 12/31 as we can not assure delivery after that point

    As we do not know what will happen 01/01/15 because SSE will no longer be Legal

      I will be doing them until the last day of the month unless I hear strong evidence otherwise. If a certain handgun falls off the roster on the 1st of the month I can still start the DROS the day before it falls off and then transfer it to the customer when the 10 day hold is up even though it is after the firearm has fallen off. I don't necessarily have supporting documentation so anyone feel free to follow up with actual laws if they exist on the subject but as of now I'm treating it just like any other sale.

        I agree if the pistol in question falls off you are GTG

        But if the pistol in question is removed from the roster the DROS will be voided by doj

        The SSE transfer will not be Legal in 2015 so the reel ??? is will SSE delivery be Legal in 2015

        We do not know and they will not answer the ?

          This is different from falling of the Roster.

          The change to 32100 (b) is
          However, Article 4 (commencing with Section 31900) and Article 5 (commencing with Section 32000) shall apply to a semiautomatic pistol that has been temporarily or permanently altered so that it will not fire in a semiautomatic mode.
          32000 says

          (a) Commencing January 1, 2001, any person in this state who manufactures or causes to be manufactured, imports into the state for sale, keeps for sale, offers or exposes for sale, gives, or lends any unsafe handgun shall be punished by imprisonment in a county jail not exceeding one year.
          32000 is the standard 'you cannot transfer unsafe handguns'. The modification to 32100(b) says that SSE guns are no longer exempt - as of Jan 1, 2015, SSE guns are 'unsafe' and they cannot be transferred to Ordinary Mortals.

          Consult your own attorney to confirm, but I would be surprised if he/she told you something substantially different.

            So based on your interpretation Librarian, It appears that as of 1/1/15, any gun in the dealers possession that is in single shot configuration could not be transferred. Even though paperwork for the transfer shows it started on say 12/24, Delivering it on 1/3 would not be legal.

            What say you??

              I agree with that interpretation. Delivery of such a gun on or after 1/1/2015 seems to me to be prohibited.

                I agree there is enough gray area that I will probably not risk a few hundred dollars in profit risking some jail time and will probably be taking the route of making sure to deliver all by 12/31/14. I will say however that the way that it is written is does not specifically name "deliver" a gun from a sale. I would already consider the gun sold and modified previous to end of the year but that's me. Still, I am no lawyer and they do get expensive so like I said probably would cost more for the lawyers advice then just not selling a few guns at the end of the month

                  It looks like 2 FFLs are doing SSE through 12/31/2014 and pickup by 1/30/2015.



                  That being said it looks like we should be good to go through end of year.

                      This is a toughie. Certainly the statutes don't seem to expressly contemplate it. We're working with DOJ to try and come up with a solution based on their enforcement plans (if any). We'll update once there's something we can share.

                        Brandon, please clarify, since my potential next purchase (1 in 30 rule) is right around 12/19, that will be very close to 12/31. Also, if I bring the SSE after 1/1 back to have it convert to a normal semi, does it matter, or it has to be done before 1/1 also?

                          Robert, since you are my FFL, I do need to know, as I have mentioned about potentially getting a Pardini GT45 and the only way to do it is using the SSE method.

                            Seems as though we are now hearing that 12/31 is the new date



                            With that, we will join the 12/31 crowd and Conduct SSE transfers until year end.
