    FFL Forcing me to wait 11 not 10 days...

    So 11 days ago, Monday Oct 28th, I did a PPT at ***** gun smithing and ******** *****. They were/are on the unprofessional side of things, but they seem like good people with good intentions. Yesterday, Thursday Nov 7h, I called in to confirm the time for me to pick up my rifle and was told to hurry up (going to Orange from Rancho Cucamonga) as the ONLY guy that could release firarms was leaving in 1 hour. When I got there he then tells me that I'm early. I figured a couple minutes early. He then tells me that I'm 1 day early and need to come back. I explain that I'm not early it's been 10 days and I should be able to release it in a few minutes not days. He then tells me no it was drosed on Tuesday not Monday. I corrected him and explained that I filled out paperwork and did the transfer on Monday. He shouted at me that "just because you did the paperwork doesn't mean it got drosed". All this was after I called to confirm that I was able to pickup my rifle. No one ever told me at the time of filling out the dros form that they were going to take an extra day, they never called me to inform me, and when I called prior to showing up there was no mention of this extra day... I've done 30+ transfers in the last 3 years and this is the 1st time I've run into this.

    My question is simple, beyond horrible customer service, can they do that? Can they choose to submit a dros when ever they please and hold my firearm for longer than 10 days?

        just deal with it and not ever do business with them again. Looks like they procrastinated on the DROS and now you have to wait.

              In theory they are supposed to do a DROS worksheet if they don't submit the DROS right away. So they might be in violation. However, no one cares. So yes, the can do that and they did.

              Sounds like a stupid way to do business to me. I like to start your ten days right then and there while you are in the shop so I can tell you the exact time and date you can return. If for some reason my Internet is down, I will start it later and then inform you when your ten days are up.

              Then again, I like to serve my customers and have them return. Unless it is a PPT of course. Then I will force you to bring in a signed written request to conduct the PPT.

                Its rather common. CYA kind of thing. I'm the kind of guy waiting at the counter for the minute hand to strike so I can get my pick up, so I know how annoying it is!

                As for poor customer service, that's a deal breaker for me. I won't give my money to some one who doesn't appreciate it.

                  In this case it was not a "wait 11 days" thing. It was a "We didn't start you for an extra day so your 10 days are not up until tomorrow." Quite different.

                  The new DROS system is going to take away the "My employees are too dumb to count" excuse as dealers will have to notify DROS when they deliver. If you try to deliver too soon, it will tell you. If you try to deliver too late (30 day expiration), it will tell you.

                  I think I will still keep my 10 day wait clock on the wall.

                      I'm sorry you had that experience. Yes I think they were in the wrong on several counts:

                      Apparently didn't submit your paperwork right away
                      Didn't double-check your paperwork when you called to make sure you could pick up
                      Yelled at you for asking a question - I'm assuming here that you were calm and professional and the guy just lost it out of a clear blue sky without any build-up.

                      What should have happened:
                      Should have filed your paperwork to DOJ as soon as you completed it, on the spot
                      Should have checked paperwork
                      Should have treated you in a more professional manner

                      It's not uncommon for a dealer to ask a person to wait an additional calendar day just so there is no confusion over whether your paperwork went in at 9 am or 9 pm or even needing to keep track of what time of day the papers were signed. Sure it's nice to not have to wait one gol-durn extra minute for a gun you are legally only obligated to wait ten days and one second for. I know we are all like little kids on christmas morning when it comes to getting our mits on that shiny new gun. However, in a practical sense, what are you going to do on day ten that can't just as well be done on day 11, assuming you have other guns?

                      I could see it maybe being an issue for someone who is totally unarmed, who is living under the threat of some kind of violence. It just doesn't seem like a big deal to me personally.

                      I'm sure others have opinions that "a right delayed, even for a day, is a right denied, for a day!" and in terms of hard-core logic I will admit they're right. It just doesn't affect me enough to care about a thursday vs wednesday sort of scenario. I'd like to get rid of the wait entirely. But while we live with it, it seems to make little practical difference whether the wait is ten days or eleven.

                      To a gun seller, who maybe has gotten dinged by the DOJ for an employee mistakenly releasing a gun a couple hours early (oops!) and is in fear for their license, I can see taking the extra day seeming like a prudent safety precaution to avoid honest mistakes that might cost them their business.

                        Regardless of whether they started the paperwork right away or not (they need to get a signature on the DROS or DROS worksheet and a thumbprint), there is nothing in the law which demands that the firearm be turned over to the second after the 240 hours is up. The FFL can have a policy to wait until the next day (even though I think it is a bad policy).

                        You need to be aware of what the policy is before you do business with them.

                          I recently had experience with this at Bullseye in Marin. I stared the punk behind the counter down and got my gun, but they have lost me.

                          I got home and tried to figure out the state code for this, and I don't see anything to prevent a dealer from keeping YOUR paid for and owned firearm for up to 30 days, at which point a new DROS would be required. A little void in the code logic, to say the least.
